For the purposes of this chapter, the following terms shall have the meaning ascribed to them herein:
CONSTRUCTION MATERIALS
Loads of stone or pavers or any other type of materials utilized in general construction or improvements, including items on skids or pallets.
DUMPSTER
A device or container used or intended to be used for the storage of bulky waste, construction debris, refuse or similar materials.
PORTABLE STORAGE FACILITY
A portable device or container used or intended to be used for the storage of personal property.
It shall be a violation of this chapter for any person to place, or to have another person place, one or more dumpsters, construction materials or portable storage facilities upon any public street or within any public right-of-way.
A. 
Any person violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $2,000, by imprisonment for a term not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
B. 
The violation of any provision of this chapter shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
C. 
In the event any dumpster, construction materials or portable storage facilities are placed in a public street in violation of this chapter and same is deemed to be a safety issue of an emergent nature by the Chief of Police and the Township Administrator, the Township may remove, or arrange to have removed, the dumpster, construction materials or portable storage facilities from the public street.
