As used in this chapter, the following terms shall have the meanings indicated:
PUBLIC PLACE
Any place to which the general public has access and a right to resort for business, entertainment or other lawful purpose but does not necessarily mean a place devoted solely to the uses of the public. It shall also include the front or immediate area of any store, shop, restaurant, tavern or other place of business and also public grounds, areas or parks.

The purpose of this chapter is to regulate certain conduct which is not subject to regulation within the New Jersey Criminal Code, Title 2C. Certain conduct and behavior, including but not limited to, disorderly conduct and lewd behavior, which are not specifically included within this chapter, are subject to prosecution under N.J.S.A. 2C:33-2 and/or other state law as applicable.

No person within the limits of Township shall swim, bathe or be found in a state of nudity, full or partial, while bathing in the waters of the Atlantic Ocean, Barnegat Bay or waters adjacent thereto, and no person shall appear in a state of nudity, full or partial, on any boat or other craft within the limits of Township.
No person shall undress or disrobe, or dress or robe, for the purpose of uncovering a bathing suit, in any motor vehicle while the same is parked on any road, street, avenue, beach or other public place. This section shall not apply to outer clothing or to children under the age of five years.

No person over the age of 18 years shall, within the limits of the Township, lodge in any automobile, truck, camping or recreational vehicle or similar vehicle in any public street, parking lot or other public property.

No person shall park any motor vehicle or trailer so that the same shall obstruct any public sidewalk in Stafford Township.

It shall be unlawful for any person to urinate or defecate in any public place except in such places as may be provided for such use.

No person or persons shall make, aid, countenance or assist in making any disturbance, riot or breach of the peace in the streets or elsewhere within the Township.

A. 
Prohibition. It shall be unlawful for any person to sell, possess or use fireworks with the Township of Stafford, unless specifically permitted and properly licensed under Chapter 110 of this Township Code. Said prohibited fireworks shall include but not be limited to firecrackers, roman candles, bombs, shells and mortars, multiple tube devices, rockets, and other devices of similar construction.
B. 
Exceptions. Notwithstanding Subsection A above, it shall be lawful for a person to offer for sale, sell, possess, or use:
(1) 
A toy pistol, toy cane, toy gun, or other device in which paper or plastic caps containing 0.25 grains or less of explosive compound per cap are used, providing they are so constructed that the hand cannot come in contact with the cap when in place for use, and toy pistol paper or plastic caps which contain less than 0.20 grains of explosive mixture per cap;
(2) 
Sparkling devices and novelties as defined in N.J.S.A. 21:2-2, including but not limited to hand held or ground based sparklers, snakes, and glow worms; smoke devices; and trick noisemakers, including party poppers, snappers, and drop pops, if the person is 16 years of age or older.

A. 
Any person violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $1,000, by imprisonment for a term not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
B. 
The violation of any provision of this chapter shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
