If, before favorable referral and final approval
has been obtained, any person transfers or sells or agrees to sell,
as owner or agent, any land which forms a part of a subdivision on
which, by ordinance, the Planning Board and the governing body is
required to act, or if any person violates or fails to comply with
any of the provisions of this chapter, such person shall, upon conviction
thereof, be punishable by a fine of not more than $500 or by imprisonment
for a term not to exceed 90 days, or by both such fine and imprisonment,
in the discretion of the Judge. The continuation of such violation
for each successive day, and each parcel, plot or lot so disposed
of, shall constitute a separate offense, and the person or persons
allowing or permitting the continuation of the violation may be punished
as provided above for each separate offense.
