The provisions of this chapter are for the purpose
of regulating all games of chance held, operated or conducted within
the township, pursuant to acts of the Legislature of the State of
New Jersey, known as the "Bingo Licensing Law" and "Raffles Licensing
Law,"[1] and in accordance with the rules and regulations issued
and/or to be promulgated by the Legalized Games of Chance Control
Commission in the Department of Law and Public Safety, Division of
Consumer Affairs of the State of New Jersey. All applications, licenses
and proceedings in connection therewith shall be subject to the provisions
of such acts and the rules and regulations promulgated thereunder
and any laws, rules and regulations hereinafter enacted and shall
be further subject to provisions of this chapter.

All licensees authorized by law to conduct any
games of chance, including raffles and bingo, shall be permitted to
conduct the same on any day of the week, including Sundays.
No license to conduct a game of chance authorized
by law shall be issued to any organization not having a bona fide
status established in good faith within the State of New Jersey and
actively engaged in serving one or more of the authorized purposes
defined by the rules and regulations of the Legalized Games of Chance
Control Commission.
A.
Licensing fees for bingo and raffle applications within
the Township of Washington shall be as follows:
(1)
Bingo: $10 for each occasion on which bingo is held.
(2)
Raffles:
(a)
On-premises draw raffles awarding cash or merchandise
as a prize: $10 for each day on which the drawing is held.
(b)
Off-premises draw raffles awarding merchandise
as a prize: $10 per $1,000 or part thereof of the retail value of
awarded prize(s).
(c)
Non-draw raffles. Carnival wheels and games:
$10 for each shell or game conducted on any day or series of six consecutive
days in any week.
(d)
Off-premises raffles awarding cash as a prize
(50/50s): $10 per $1,000 or part thereof of the retail value of the
awarded prize(s).
B.
Fees for bingo licenses and for raffle licenses as set forth above in Subsection A(2)(a), (b) and (c) are due in full at the time that the application is filed with the township. For raffle licenses set forth in Subsection A(2)(d), a ten-dollar fee is due at the time that the application is filed, and, if the awarded prize(s) exceeds $1,000, an additional fee of $10 per $1,000 or part thereof awarded as a prize is due upon the filing of the report of operations.
C.
Irrespective of above, any organization showing an
approved nonprofit status pursuant to Internal Revenue Code and the
laws and rules of the State of New Jersey shall be exempt from the
fees set forth herein.
No games of chance shall be conducted under
any license at any time during when a general, municipal, primary,
special or Board of Education election is being held while the polls
are open for voting.

The Municipal Clerk is hereby delegated the
authority to act as the issuing authority to approve the granting
of games of chance, bingo and raffle licenses.
