Definitions. For the purpose of this chapter, the following
terms, phrases, words and their derivations shall have the meanings given
herein:
The placement of yard waste in a trash can, bucket, bag or other
vessel, such as to prevent the yard waste from spilling or blowing out into
the street and coming into contact with stormwater.

Putrescible animal and vegetable wastes resulting from the handling,
preparation, cooking and consumption of food.
Solid waste is removed at once, without delay.

Garbage, refuse, rubbish, pet solid waste, as defined herein, and
all other waste material which, if thrown, deposited or stored as herein prohibited,
tends to create a danger to public health, safety and welfare.

A conveyance or system of conveyances (including roads with drainage
systems, municipal streets, catch basins, curbs, gutters, ditches, man-made
channels, or storm drains) that is owned or operated by the Township of Washington
or other public body, and is designed and used for collecting and conveying
stormwater. This does not include combined sewer systems, which are sewer
systems that are designed to carry sanitary sewage at all times and to collect
and transport stormwater from street and other sources.

Any person who shall possess, maintain, house or harbor any pet or
otherwise have custody of any pet, whether or not the owner of such pet.

Any individual, corporation, company, partnership, firm, association,
organization or political subdivision of this state subject to municipal jurisdiction.

A domesticated animal (other than a disability assistance animal)
kept for amusement or companionship.

Waste matter expelled from the bowels of the pet; excrement.

Placement in a designated waste receptacle or other suitable container,
and discarded in a refuse container which is regularly emptied by the municipality
or some other refuse collector; or disposal into a system designed to convey
domestic sewage for proper treatment and disposal.

Any streets, sidewalks, alleys or other public ways and any and all
public parks, squares, spaces, grounds and buildings.
Any structure or building owned or operated by the federal, county
or state government or any governmental agency.
All putrescible solid wastes, except body wastes, including garbage,
rubbish, ashes, street cleanings, dead animals, abandoned automobiles, dismantled
automobiles and parts thereof, scrap metal, junk, machinery and solid market
and industrial wastes.
Nonputrescible solid wastes, consisting of both combustible and noncombustible
wastes, such as papers, wrappings, cigarettes, cardboard, tin cans, yard clippings,
leaves, wood, glass, bedding, crockery, building materials and similar materials.
Water resulting from precipitation (including rain and snow) that
runs off the land’s surface, is transmitted to the subsurface, is captured
by separate storm sewers or other sewerage or drainage facilities, or is conveyed
by snow removal equipment.

Any street, alley, avenue, boulevard, road, parkway, viaduct, drive
or other way which is an existing state, county or municipal roadway, and
includes the land between the street lines, whether improved or unimproved,
and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas,
and other areas within the street lines.

The Township of Washington.
Every device in, upon or by which any person or property is or may
be transported or drawn upon a highway, including devices used exclusively
upon stationary rails or tracks.
Leaves and grass clippings.

A.
No person shall throw or deposit litter in or upon any
street, sidewalk or other public place within the township except in public
receptacles or in authorized private receptacles for collection; provided,
however, that said public receptacles shall not be used by persons owning
or occupying property in the vicinity of said public receptacles for the deposit
of domestic, commercial and industrial litter arising from the conduct of
said activities.
B.
Persons placing litter in public receptacles or in authorized
private receptacles shall do so in such a manner as to prevent it from being
carried or deposited by the elements upon any streets, sidewalks or other
public places.

The owner or occupant of any property, or any employee or contractor
of such owner or occupant, engaged to provide lawn care or landscaping services
shall not sweep, rake, blow or otherwise place yard waste in the street. If
yard waste is placed in the street, the party responsible for placement of
yard waste must remove the yard waste from the street or said party shall
be deemed in violation of this chapter.

A.
The spilling, dumping, or disposal of materials other
than stormwater to the municipal separate storm sewer system operated by the
Township of Washington is prohibited. The spilling, dumping or disposal of
materials other than stormwater in such a manner as to cause the discharge
of pollutants to the municipal separate storm sewer system is also prohibited.
B.
Exceptions to prohibition.
(1)
Water line flushing and discharges from potable water
sources.
(2)
Uncontaminated groundwater (e.g., infiltration, crawl
space or basement sump pumps, foundation or footing drains, rising groundwaters).
(3)
Air-conditioning condensate (excluding contact and noncontact
cooling water).
(4)
Irrigation water (including landscape and lawn watering
runoff).
(5)
Flows from springs, riparian habitats and wetlands, water
reservoir discharges and diverted stream flows.
(6)
Residential car washing water, and residential swimming
pool discharges.
(7)
Sidewalk, driveway and street wash water.
(8)
Flows from fire-fighting activities.
(9)
Flows from rinsing of the following equipment with clean
water:
(a)
Beach maintenance equipment immediately following its
use for its intended purposes; and
(b)
Equipment used in the application of salt and deicing
materials immediately following salt and deicing material applications. Prior
to rinsing with clean water, all residual salt and deicing materials must
be removed from equipment and vehicles to the maximum extent practicable using
dry cleaning methods (e.g., shoveling and sweeping). Recovered materials are
to be returned to storage for reuse or properly discarded.
(c)
Rinsing of equipment, as noted in the above situation,
is limited to exterior, undercarriage, and exposed parts and does not apply
to engines or other enclosed machinery.
No person shall sweep into or deposit in any gutter, street or other
public place within the Township of Washington the accumulation of litter
from any building or lot or from any public or private sidewalk or driveway.
Persons owning or occupying property shall keep the sidewalk in front of their
premises free of litter.
No person, while a driver or passenger in a vehicle, shall throw or
deposit litter upon any street or other public place within the township.
No person shall drive or move any truck or other vehicle within the
township unless such vehicle is so constructed or loaded as to prevent any
load or contents of litter from being blown or deposited upon any street,
alley or other public place.
No person shall throw or deposit litter in any pond, lake, stream or
any other body of water in a park or elsewhere within the township.
A.
No person shall throw, deposit or store litter on any
private property within the township, whether owned by such person or not,
except that the owner or person in control of private property may maintain
authorized private receptacles for collection and removal of same.
B.
The owner or person in control of any private property
shall at all times maintain the premises free of litter, particularly one
or more automobile bodies, frames or chassis, one or more automobiles unable
to be self-propelled or one or more abandoned automobiles.
C.
All pet owners and keepers are required to immediately and properly
dispose of their pet’s solid waste deposited on any property, public
or private, not owned or possessed by that person. Any owner or keeper who
requires the use of a disability assistance animal shall be exempt from the
provisions of this section while such animal is being used for that purpose.

Any person violating or failing to comply with any of the provisions
of this chapter shall, upon conviction thereof, be subject to a fine of not
more than $500, or may be imprisoned in the county jail for a term not to
exceed 90 days, or both. Each day such violation is committed or permitted
to continue shall constitute a separate offense and shall be punishable as
such.

The provisions of this chapter shall be enforced by the Washington Township
Police Department, the Principal Public Works Manager, the Zoning Official
and, in cases of pet waste violations, the Washington Township Animal Control
Officers.
