Township of Washington, NJ Chapter 119 Vehicles, Unlicensed Motor-Driven

§ 119-1 Definitions.

For the purpose of this chapter, the terms used herein are defined as follows:

PRIVATE PROPERTY

All lands and premises situate within the Township of Washington, Warren County, and not included in the categories of public or quasi-public property as herein defined.

PUBLIC PROPERTY

All parks, recreation areas, parking lots, streets, sidewalks, easements or rights-of-way owned by the Township of Washington, the Board of Education of the Township of Washington or the Warren Hills Regional Board of Education.

QUASI-PUBLIC PROPERTY

All parks, recreation areas, parking lots, streets, sidewalks or rights-of-way owned by the Board of Education of the Township of Washington, the Warren Hills Regional Board of Education or any other person, firm or corporation to which the public is generally invited such as, by way of example, the parking lots of shopping centers or retail stores.

§ 119-2 Operation on public property prohibited.

It shall be unlawful for any person to operate any type of unlicensed motor-driven vehicle or conveyance, including but not limited to two-wheeled motor vehicles known as "minibicycles," "trail bicycles" or motor scooters and four-wheeled motor vehicles commonly known as "go-carts," upon any public property within the Township of Washington.

§ 119-3 Operation on quasi-public or private property.

The operation of motor vehicles as described in § 119-2 hereof is additionally prohibited upon private property and quasi-public property unless the operator has in his possession the written permission by the owner of said property to operate said vehicle thereon or unless the operator is a member of or in the company of a member of the family of the owner or lessee of said property.

§ 119-4 Unnecessary noise or disturbances prohibited.

It shall be unlawful to operate any unlicensed motor vehicle as described in § 119-2 hereof in such a manner as to create loud, unnecessary or unusual noise or in any other manner so as to disturb or interfere with the peace and quiet of other persons.

§ 119-5 Careless or negligent operation prohibited.

It shall be unlawful to operate any unlicensed motor vehicle as described in § 119-2 hereof in a careless, reckless or negligent manner so as likely to endanger the safety or property of any person.

§ 119-6 Exceptions.

The operation of unlicensed motor-driven construction equipment, road maintenance equipment and farm equipment shall not be prohibited by the terms of this chapter.

§ 119-7 Responsibility of parent or guardian.

It shall be unlawful for the parent, guardian or any person having the care, custody and control of any minor under the age of 17 years to permit such child to operate a motor-driven vehicle in violation of the terms of this chapter.

§ 119-8 Violations and penalties.

Any person who shall violate any of the provisions of this chapter shall, upon conviction thereof, be sentenced to a fine not exceeding $500 or to imprisonment for a term not exceeding 90 days, or both.
