A. 
The owner of every existing building or structure and the owner of every building or structure hereafter to be constructed or acquired which may be occupied or used by human beings, including but not limited to dwellings and commercial and industrial structures located on a street or road along the line of a public water supply system and available to serve said building or structure, where the property line of a lot in a residential zone containing said building or structure is within 100 feet of said water supply system and where the property line of a lot in a commercial or industrial zone containing said building or structure is within 400 feet of said water supply system shall, within 90 days after the date on which the water supply is made available to said building or structure, connect and hook up said building or structure to said water supply system.
B. 
For purposes of this chapter, the connection and hookup required by Subsection A hereof shall include the capping and sealing of any existing wells serving said building or structure, unless exempted by the State of New Jersey or any of its duly authorized agencies.

If the owner of any house, building or structure referred to in § 121-1 hereof shall fail to make any connection required by this chapter within the time herein required, the township may proceed to make such connection, or cause the same to be made, and assess the cost thereof as a lien against such house, building or structure pursuant to, and in accordance with, the provisions of N.J.S.A. 40:63-52 through 40:63-64.[1]

In the case of existing buildings and structures served by private wells, connection shall not be required unless the building or structure is in an area wherein it has been shown that the aquifer contains contaminants which exceed the maximum contaminant levels established under the New Jersey Safe Drinking Water Act.[1]

Any person, association or corporation who shall fail to comply with this chapter within 90 days after notice by the Health Officer of the Township of Washington shall, upon complaint in the Central Municipal Court of Warren County, be subject to a fine of not more than $500 or imprisonment for a term not to exceed 90 days, or both and, in addition, shall be subject to a fine of not more than $10 for each day of delay after the expiration of the 90 days in which the provisions of the notice are not complied with.
