As used in this chapter, the following terms shall have the meanings indicated:
RETAIL FOOD HANDLING ESTABLISHMENT
Includes restaurants, taverns, box lunch establishments, bakeries, meat markets, delicatessens, luncheonettes, caterers, soda fountains, food vending vehicles and any other place in which food or drink is prepared or stored for public consumption, distribution or sale at retail, including any vehicle used in connection therewith.
A. 
No person shall operate a retail food handling establishment unless a license or the approval of an existing certificate or license to operate the same shall have been authorized and issued by the Board of Health. Such license or approval of an existing license shall be posted in a conspicuous place in such establishment, or in the case of a vehicle, the license shall always be available for inspection by any public authority.
B. 
Licenses shall be issued hereunder only upon payment of the following license fees:
(1) 
For establishments and places where food or drink is sold or distributed in a manner other than in the same sealed or wrapped package or container in which it was received, the sum of $25.
(2) 
For establishments and places where food or drink is sold or distributed to consumers in the same sealed or wrapped package or container in which it was received, either with straws, spoons or other utensils for eating or drinking or with ingle-service straws or spoons, the sum of $10.
(3) 
For vehicles used in connection with any retail food handling establishment, the sum of $5 for each vehicle.
C. 
All licenses issued or approved under the provisions of this chapter shall expire annually on December 31 of each year, and application for renewal thereof shall be submitted, together with the required fee, prior to January 1 of each year. Where there seems to be justification for such action, license fees may be prorated upon first issuance.
D. 
A person conducting an itinerant retail food handling establishment shall secure a license, or if such person is the holder of a license issued by the Board of Health of another jurisdiction, said license may be approved by the Board of Health of the City of Woodbury and there shall be a fee of $5 charged for such approval.
E. 
Any license or approval of a certificate or license issued by another Board of Health is not transferable hereunder.
Any person who violates any provision of or order promulgated under this chapter shall, upon conviction thereof, be liable to a penalty of not less than $2 nor more than $500 for each violation, and each day a particular violation continues shall constitute a separate offense.
