[Adopted 6-10-1992 by Ord. No. 92-1BH (Ch. 266, Art. II, of the 1985 Code)]
As used in this article, the following terms shall have the meanings indicated:
MIGRATORY WATERFOWL
Includes those species of birds commonly known as "geese," "ducks" and "swans" and any other waterfowl falling under the jurisdiction of the United States Fish and Wildlife Service.
It shall be unlawful for any person to:
A. 
Feed any migratory waterfowl on public property in the Borough of Woodcliff Lake.[1]

B. 
Create any condition which results in a congregation or congestion of migratory waterfowl on public property which:
(1) 
Results in an accumulation of waterfowl feces or droppings.
(2) 
Results in damage to flora, fauna or public property.
(3) 
Results in a threat or nuisance to the public health safety or welfare.
(4) 
Results in a threat to the health, safety or welfare of said migratory waterfowl.
A. 
This article shall be enforced by the Health Officer/Agent and the Police Department of the Borough of Woodcliff Lake.
B. 
Whenever the Board of Health or President of the Board of Health or the police become aware that migratory waterfowl are being fed in violation of this article, they may issue a summons which shall be answerable before the Municipal Judge.
C. 
Whenever the Board of Health or President of the Board of Health becomes aware that a congregation or congestion of migratory waterfowl exists on public property, he may disperse or remove them by any lawful means. However, before such dispersal or removal takes place, the Health Officer/Agent shall meet and confer with the Board of Health or its President and, with their advice and consent determine the appropriate method, and considering first the health, safety and welfare of the citizens of Woodcliff Lake and second the health, safety and welfare of the migratory waterfowl.
D. 
Whenever the Board of Health or President of the Board of Health determines that the waterfowl shall be dispersed by noise tactics, he may request assistance for the implementation of the plan from the Police Department and/or the Public Works Department or from any responsible citizen or citizens. This subsection shall not be construed to authorize any private citizen to discharge any firearm or to use any device which launches a projectile of any type. It shall be used in a reasonable way respecting the rights of surrounding houses from excessive noise levels.
E. 
The Health Officer/Agent shall apply for and secure all permits necessary by law before dispersing or removing the migratory waterfowl.
Any person who is guilty of feeding migratory waterfowl shall be punished by a fine of $10 and two hours of community service for the first offense and $25 and five hours of community service for the second and subsequent offenses.
