As used in this chapter, the following terms shall have the meanings
indicated:
DUMPSTER
A container which holds garbage, refuse, ashes, and building material,
which is designed to be emptied by being raised into the air and turned so
that the contents are placed in a garbage truck for disposal.
TEMPORARY BASIS
A dumpster that is used for the temporary removal of debris and which
shall not be located on the premises for more than 60 days in one calendar
year.
Any commercial, industrial or business that uses a dumpster on other
than a temporary basis shall locate said dumpster not closer than 50 feet
from any building.
All dumpsters other than those used on a temporary basis shall be screened
on three of four sides (not including the side it is to be emptied from) as
needed to screen the dumpster from view from public streets or dwellings on
abutting lots. A solid wooden fence, brick wall, evergreen plants or structures
designed to be architecturally compatible with the principal building shall
be used for such screen.
Such containment shall be maintained in such a manner as to prevent
litter and debris from being in the area surrounding the dumpster.
Any removal of refuse from dumpsters shall not occur between the hours
of 11:00 p.m. and 7:00 a.m.
Any user of a dumpster violating any provision of this chapter shall
pay a fine of not more than $600 per offense, plus costs of prosecution, and,
in default of payment of such fine and costs, shall undergo imprisonment for
a period not exceeding 30 days.
