As used in this chapter, the following terms
shall have the meanings indicated:
Any person under the age of 18 years.
Persons under the age of 18 years.
It is unlawful for any child to be in or upon
or to enter or remain in or upon any street, park or other public
place within the Town at any time during the period from 10:00 p.m.
on Sunday through Thursday and 11:00 p.m. on Friday and Saturday until
1/2 hour before sunrise of the next succeeding day, unless such child
is accompanied by a parent, guardian or other person having the legal
custody of such child.
It is unlawful for any parent, guardian or other person having the legal custody of any child to allow or permit such child to go or be in or upon any street, park or other public place within the Town during the period prohibited in § 74-2, except as therein provided.
Appropriate Town officers and law enforcement personnel, in taking children into custody under the provisions of § 74-2 shall use their discretion in determining age, and in doubtful cases may require positive proof, and until such proof is furnished, the officer's judgment shall prevail.

Any child found in and upon any of the streets, parks or other public places within the Town in violation of § 74-2 shall be taken into custody by the appropriate Town officials or law enforcement personnel and delivered to his or her parent, guardian or person having the legal custody of such child, and a report thereof made to the Code Enforcer or other individual designated by the Town, who shall make a record thereof in a book kept for that purpose, and if such parent, guardian or person having the legal custody of such child shall again allow him or her to be in said streets, parks or other public places in violation of § 74-2, such parent, guardian or person having the legal custody of such child so offending shall, upon conviction, be punished as provided in § 135-9, and a like penalty shall be imposed on any person aiding or abetting in the violation of the intent and purpose of §§ 74-2 and 74-3.
