Any person who shall act in a violent or tumultuous manner toward another, whereby any person is placed in fear of safety of his or her life, limb or health.

Any person who shall act in a violent or tumultuous manner toward another, whereby property of any person is placed in danger of being destroyed or damaged.

Any person who shall endanger lawful pursuits of another by acts of violence, angry threats and abusive conduct.

Any person who shall cause, provoke or engage in any fight, brawl or riotous conduct so as to endanger the life, limb, health or property of another.

Any person who shall assemble or congregate with another or others for the purpose of causing, provoking or engaging in any fight or brawl.

Any person who shall be found jostling or roughly crowding or pushing any person in any public place.

Any person who shall assemble with others or in crowds for unlawful purposes.

Any person who shall assemble or congregate with another or others for the purpose of or with the intent to engage in gambling.

Any person who shall frequent any public place with intent to obtain money or other valuable thing from another by an illegal and fraudulent scheme, trick, artifice or device, or who shall aid or abet therein.

Any person who utters, while in a state of anger, in the presence of another any lewd or obscene words or epithets, or "fighting words" and thus creates turmoil.

Any person who frequents any place where gambling or the illegal sale or possession of alcoholic beverages or narcotics or dangerous drugs is practiced, allowed or tolerated.

Any person who shall act in a dangerous manner toward others.

Any person who shall assemble or congregate with another or others for the purpose of doing bodily harm to another.

Any person who shall, by acts of violence, interfere with another's pursuit of a lawful occupation.

Any person who shall congregate with another or others in or on any public way so as to halt the flow of vehicular or pedestrian traffic and who refuses to clear such public way when ordered to do so by a peace officer or other person having authority.

§ 135-2 Disturbing the peace.

It is unlawful for any person to disturb the peace by shouting, hallowing, use profane, vulgar or obscene language or in any other manner or to assemble with others for any such purpose.

It is unlawful for any person to disturb the peace by the mischievous or malicious ringing of doorbells or by throwing stones against or beating upon any door, fence, gate or house.

Divine services.

(1)

It is unlawful for any person to disturb any service of worship of God in any place of worship or to conduct himself in such manner as to molest, annoy, disturb or insult any clergyman or other person during the continuance of a divine service or during the assembling or dispersal of the congregation thereat.

(2)

It is unlawful for any persons to collect together and stand, sit, lounge or be about the pavements, front yards or premises of any place of worship during the hours of public worship or of any religious exercises or Sunday school or other meetings in such place of worship.

It is unlawful for any person during the hours of the holding of any public meeting or of the assemblage of people to witness any public performance in any building or hall to behave in a rude, noisy, vulgar or improper manner, either in front of or adjacent to such building or hall or within the same.

§ 135-3 Public intoxication.

It is unlawful for any person to be drunk in any public place.

§ 135-4 Expectoration in public.

It is unlawful for any person to expectorate upon any public street or sidewalk or upon or within any public place or upon the floor of any building which is open to the public.

§ 135-5 False alarms.

No person shall knowingly give or cause to be given any false alarm of fire.

No person shall knowingly give or cause to be given any false alarm of explosion or impending danger of explosion.

No person shall knowingly give or cause to be given any false alarm of the need for police protection of assistance.

No person shall knowingly give or cause to be given any false alarm of the need for an ambulance or medical assistance.

§ 135-6 Loitering.

It is unlawful for any person to loiter on any of the parking lots, streets and alleys and near public places within the Town.

Loitering within 50 feet of retail establishments which sell alcoholic beverages.

(1)

It is unlawful for any person or persons who are standing or loitering within 50 feet of a retail establishment which sells alcoholic beverages, in such a manner as to obstruct free passage on or along the street or sidewalk, to disobey a request by a police officer to move on.

(2)

The fifty-foot distance mentioned in this section is to be measured along the street or other public way in both directions from the center of the main entrance or any other entrance used by the public of the retail establishment.

(3)

Nothing contained in this section is intended to prevent property owners or their guests from sitting on their front steps or standing on their sidewalks in front of their property, regardless of whether or not the property is within the fifty-foot line.

It is unlawful for any person who is without a business purpose for being there to loiter in any public or private school building, around an entrance thereof, upon school grounds or upon a public way within 100 yards of the school grounds and to refuse to leave such premises when requested to do so by a school security officer or law enforcement official.

§ 135-7 Games in streets.

It is unlawful for any person to play at any ball game or to throw any ball or other missile on any public street or sidewalk or in any public place other than a playground or duly designated play street.

§ 135-8 Protection of property.

It is unlawful for any person, knowingly and without property authority, to tamper with, remove, render inoperative, damage, deface or otherwise interfere with or molest any personal or real property belonging to another or to knowingly and without property authority tamper with, remove, render inoperative, damage, deface or otherwise interfere with or molest any personal or real property of any public service company.

No person shall knowingly and without proper authority destroy, damage, deface, molest otherwise interfere with any real property of another or knowingly trespass upon the real property of another.

§ 135-9 Violations and penalties.

Any violation of Chapter 1, Article II, Prohibited Acts; Chapter 74, Curfew; Chapter 88, Firearms and Other Weapons; Chapter 121, Noise; Chapter 135, Peace and Good Order; and Chapter 158, Skateboards, shall be a municipal infraction. The penalty for a violation is $50 for the initial offense, and $150 for each subsequent offense.

Article II Town Officers, Employees and Property

§ 135-10 Interference with officers and employees.

No person shall carelessly or willfully interfere with, hinder or obstruct any officer or employee of the Town who is engaged in, en route to, or returning from the performance of official duty, whether such interference, hindrance or obstruction be by threat, assault or otherwise.

§ 135-11 Impersonating officers or employees.

No person shall falsely represent himself or herself to be an officer or employee of the Town or without proper authority wear or display any uniform, insignia or credential which identifies any Town officer or employee; nor shall any person without proper authority assume to act as an officer or employee of the Town, whether to gain access to premises, obtain information, perpetrate a fraud or for any other purpose, provided that nothing in this section shall be construed to prevent a private citizen from making a lawful citizen's arrest for felony or breach of the peace committed in his or her presence.

§ 135-12 Tampering with Town property.

No person shall, without proper authority, knowingly use, tamper with, render inoperative, destroy, damage, remove, deface, molest or otherwise interfere with any books, records, furniture, equipment, gear, apparatus, tools or other items of personal property belonging to, leased to or used by the Town or any agency thereof.

§ 135-13 Damaging and trespassing on Town property.

No person shall, without proper authority, knowingly trespass upon or damage, deface, molest or otherwise interfere with any real property belonging to, leased to or used by the Town or any agency thereof.
