A. 
The Borough has previously apportioned treatment capacity for planning and design purposes based upon NJDEP estimates and generally accepted standards. Recognizing that treatment capacity is a valuable public commodity, it is the intention of the Borough that unused capacity revert to the Borough for allocation to new or expanding users having need of the same. This the Borough deems to be in the best interest of the general public.
B. 
Engineer analysis. The Borough Engineer is hereby directed to review all available reports to determine the present capacity usage for each facility presently served by the Boroughs public sewer system, which shall be based on historical usage data through the period ending the calendar year on December 31, 1997. That level of present usage shall, as of January 1, 1998, be deemed to be the recognized capacity allocation for each such property. Capacity not in use as of that date shall revert to the Borough for allocation in accordance with this chapter.
Newly allocated capacity shall be used or reserved within the time set forth within the allocation policy set forth in this chapter, else it shall revert to the Borough.
