The purpose of this article is to promote the general health, safety and welfare by requiring those properties within the Borough of Chester that are located within areas having, or threatened to have, contaminated groundwater to be connected to the Chester Borough Public Water System (the "Water System") where public water service is or may become available.
Connection to the Water System is required for the following:
A. 
Any house, building or structure which is or may be occupied or used by human beings, located on a street along any water line or extension made or to be made by New Jersey American Water Company (hereafter "New Jersey American") as part of the Minimal Capital Improvements identified in Section 31 and Exhibit F of the Agreement between New Jersey American and the Borough of Chester dated March 25, 1998 (the "Agreement"), a copy of which is on file in the office of the Borough Clerk. The following properties shall be subject to the mandatory connection requirement of this article:
(1) 
Properties located at or along the following locations:
Entire length of North Road
Entire length of Williamson Lane
Entire length of Village Road
Entire length of Larch Drive
(2) 
The following property locations on Oakdale Road:
Block 4.01, Lots 26.03, 26.04, 26.05, 26.06, 26.07, 26.08 and 26.09.
Block 5, Lots 13, 15 and 15-01
(3) 
The following property locations on Main Street:
Block 24, Lots 1.01 and 1.02
Block 4.01, Lots 26.01, 26.02, 28, 29, 30 and 30.01
Block 8, Lots 13.03 and 13.05
Block 8.01, Lots 1, 2 and 3
(4) 
The following property locations on Fairmount Avenue:
Block 8 Lots 13.04, 13.05 and 16
Block 24, Lots 2, 3, 4, 5 and 6
B. 
Any house, building or structure which is or may be occupied or used by human beings, located on a street along any portion of the Water System as the same may be extended from time to time, within an area of groundwater contamination as determined by the New Jersey Department of Environmental Protection, or by the County Health Department, or by the Board of Health of the Borough of Chester, or by any other agency having jurisdiction to make that determination.
A. 
Upon completion by New Jersey American Water Company of the Minimal Capital Improvements described in Section 3.1 and Exhibit E of the Agreement referred to in § 192-57A above, or upon completion of the construction of any extension to the Water System pursuant to that Agreement, and upon acceptance of those improvements by the Borough, a notice to connect will be served upon the owners of record for all properties then subject to mandatory connection to the Water System as provided in this article. Notice shall be effective upon mailing when given by regular first class mail sent to the last address on file with the Borough Tax Collector, or if there is no known valid address, upon publication in the Boroughs official newspaper. Connection to the Water System in accordance with all requirements of this chapter shall be made within 120 days of the giving of such notice.
B. 
Any property subject to mandatory connection to the Water System in accordance with § 192-57B above by virtue of it being determined to be located within an area of groundwater contamination by any agency having jurisdiction to make that determination shall connect to the Water System in accordance with all requirements of this chapter within 120 days of notice to connect. Notice shall be effective upon mailing when given by regular first class mail sent to the last address on file with the Borough Tax Collector, or if there is no known valid address, upon publication in the Boroughs official newspaper.
This article shall not preclude any property located on a street along any portion of the Water System that is not located within any area of contaminated groundwater from voluntarily connecting to the Water System, as the same may be extended from time to time, in accordance with the provisions of this chapter.
