There are hereby established and hereby confirmed the following offices of the Borough of Emerson, which shall have the powers and perform the duties herein set out:
A. 
Administrative Assistant.
(1) 
The Administrative Assistant to the Mayor and Council, hereinafter called the "Administrative Assistant," shall generally be the Administrative Assistant to the Borough Administrator and to the Mayor and Council. The Administrative Assistant shall perform such duties as from time to time may be assigned or designated to him/her by the Mayor and Council and/or the Borough Administrator or any committee thereof or any member thereof, within such committee's or member's appropriate jurisdiction.
(2) 
The Administrative Assistant shall in the performance of all duties act under the direct and immediate control and supervision of the Borough Administrator and the Mayor and Council and/or any committee or member thereof within their appropriate jurisdiction.
(3) 
The Borough Clerk may and customarily should be appointed the Administrative Assistant.
(4) 
The Administrative Assistant shall assist the Borough Administrator as a liaison between the Mayor and Council and all Borough officials, departments, boards and committees, and he/she shall also assist the Borough Administrator as liaison between all Borough officials, departments, boards and committees inter se.
(5) 
The Administrative Assistant shall be directly under the supervision of the Borough Administrator and shall perform such duties and functions as are regularly assigned to him/her by the Borough Administrator.
(6) 
The Administrative Assistant shall have, in the absence or disability of the Borough Administrator, all the Borough Administrator's rights and be entitled to perform all his/her duties and assume all his/her responsibilities.

B. 
Deputy Borough Clerk.
(1) 
The Deputy Borough Clerk shall have, in the absence or disability of the Borough Clerk, all the Clerk's powers and rights and be entitled to perform all his/her duties and assume all his/her responsibilities.
(2) 
Whenever the hand and seal of the Deputy Borough Clerk of this Borough shall appear upon any instrument or document of this Borough, it shall be conclusively presumed that the Borough Clerk was absent or incapacitated and the Deputy Borough Clerk executed and sealed such instruments pursuant to the authority of this article.
C. 
Deputy Borough Tax Collector.
(1) 
The Deputy Borough Tax Collector shall have, generally, all the rights, duties and obligations of the Borough Tax Collector to be exercised under his/her direct and immediate supervision and control and to be exercised by the Deputy Borough Tax Collector independently in the event of the Borough Tax Collector's death, absence or disability.
(2) 
The Deputy Borough Tax Collector's authority to act independently shall cease when the Borough Tax Collector returns or resumes his/her duties or a new Tax Collector is elected or appointed to fill the vacancy caused by death.
All the offices set out in § 57-10 hereof shall be appointed by the Mayor of the Borough of Emerson with the consent of the Borough Council.
All officers set out in § 57-10 hereof shall be paid compensation at such rates as the Mayor and Council of the Borough of Emerson shall from time to time fix pursuant to law.[1]

The term and compensation of the offices first appointed under this article shall commence on January 1, 1985.
A. 
There is hereby established the position of Deputy Borough Clerk in the Borough of Emerson.
B. 
Duties.
(1) 
The duties of the Deputy Borough Clerk shall be to assist the Borough Clerk in the following duties:
(a) 
Keeping the official minutes of meetings.
(b) 
Maintaining a proper record of all ordinances.
(c) 
Acting as custodian of all records which may be entrusted to him (her) by the governing body or by law.
(d) 
Performing such duties of a recording or clerical nature as may be required of him (her) by the governing body or statute.
(e) 
Signing all warrants or warrant checks.
(f) 
Issuance of licenses for dogs, cats, etc., within his (her) jurisdiction.
(g) 
Certification of the budget and other documents when required.
(h) 
Maintaining a proper cash receipts record of all receipts and disbursements to the Municipal Treasurer.
(i) 
Maintaining an insurance register to incorporate information relative to insurance policies and surety bonds.
(j) 
Maintaining a record of all deeds and foreclosure deeds and the disposition of same.
(k) 
Maintaining a record to contain printed copies of all legal advertisements.
(2) 
In addition, the Deputy Borough Clerk shall perform all other duties as prescribed by the Borough Clerk, including the right to act as Borough Clerk during illness, absence or incapacity of the Borough Clerk.
C. 
Appointment. The Deputy Borough Clerk shall be appointed by the Mayor with the advice and consent of the Council, and said appointment shall continue during good behavior and efficiency and may only be removed for cause. The Deputy Borough Clerk shall not be removed for political reasons.
D. 
Salary. The Deputy Borough Clerk shall receive such salary as shall be fixed from time to time by the Mayor and Council of the Borough of Emerson.[1]

A. 
There is hereby established the position of the Deputy Tax Collector of the Borough of Emerson.
B. 
Duties.
(1) 
The duty of said Deputy Tax Collector shall be to assist the Borough Collector in the following duties:
(a) 
Depositing all funds of the Borough received in the officially designated depository within 48 hours of their receipt.
(b) 
Maintaining a cashbook record of all receipts, showing date of receipt, source and classification, i.e., year of tax or other category.
(c) 
Paying over to the Borough Treasurer the receipts of each month on or before the first of the succeeding month, or oftener if required by the governing body.
(d) 
Maintaining a tax duplicate and posting all receipts applicable thereto as shown by the cashbook record. Posting all other charges and credits as may be applicable thereto, such as County Board remissions, veterans exemptions granted by the Collector and cancellation by the governing body and unpaid taxes accruable to tax-title liens.

(e) 
Extending balances of taxes remaining unpaid at the close of each year; proving cashbook posting to the cashbook record quarterly.
(f) 
Maintaining a delinquent tax arrears register to which unpaid tax balances of each duplicate are transferred and posting all subsequent action applicable to such taxes in such register.
(g) 
Holding annual tax sales for all unpaid real property taxes remaining unpaid after July 1 of the preceding year.
(h) 
Maintaining a tax-sale-list book for each sale held.
(i) 
Maintaining a tax-title-lien register for all tax-title liens acquired by the Borough as a result of such tax sales.
(j) 
Maintaining a tax-title-lien-redemption account for those tax-title liens sold to outside buyers, which may be subsequently redeemed, and paying out applicable redemption moneys to outside buyers when received.
(k) 
Computing and determining the amount necessary to redeem all tax-title liens, including accrued interest.
(l) 
Collecting interest on taxes paid after the quarterly due dates at the percentage rate designated by the governing body.
(m) 
Issuance of tax-sale certificates to outside buyers and the Borough as a result of tax sales held annually.
(n) 
Reconciling the bank account with the cashbook balance monthly.
(o) 
Preparing and mailing tax bills for the current year's taxes to each owner of record shown in the tax duplicate annually. He should also prepare bills for improvement assessments.
(p) 
Maintaining a property-acquired-by-taxes register for Borough-owned properties acquired through foreclosure or Borough-owned tax-title liens.
(q) 
Annually filing on or before:

March 31, a statement of receipts and disbursements for the year preceding.
[2] 
May 1, a list of delinquent taxes outstanding at December 31 of the year preceding.
(2) 
In addition, the Deputy Tax Collector shall perform all other duties as prescribed by the Borough Tax Collector.
C.

D. 
Salary. The Deputy Tax Collector shall receive such salary as shall be fixed from time to time by the Mayor and Council of the Borough of Emerson.[1]

This article shall take effect immediately after publication as required by law and shall be retroactive and take effect as of January 1, 1968, insofar as permitted by law.
