For the purpose of this chapter, the Township of Lower is hereby divided into 17 districts as follows:

A. 
The boundaries of these zoning districts are established on the map entitled "Zoning Map of the Township of Lower," dated May 1981 and revised May 1982, which is hereby incorporated within this chapter by reference.
B. 
The following geographic boundaries established by the Zoning Map are designated as follows:
(1) 
MD District. The MD District includes the area south of the canal comprised of Block 824.02, Lots 1, 2, 3, 4, 5 (excepting the portions of Lot 5 lying within 200 feet of US Route 109) and 15; and Block 823.02, Lot 2, 3.01 and 3.02.

(2) 
MH District. The MH District is comprised of Block 511; Block 505, Lots 34.01, 34.02, 33, 32, and 31; and Block 510, Lots 12.03, 13, 14.01, 14.02, 15.01, 15.02, 16 and 17.
(3) 
R-1 District.
(a) 
The R-1 District consists of Block 494.01, Lots 1.04, 3, 4, 24 and 28, and the area bounded on the north by a line running along the Cape May Canal from Delaware Bay eastward along the canal to Spicers Creek, then southward to the Cape May municipal boundary, then following the westerly Cape May municipal boundary until it intersects with the West Cape May municipal boundary, then following the northerly and westerly boundaries of West Cape May until it intersects with Sunset Boulevard at Seagrove Avenue, then eastward along Sunset Boulevard to the easterly limit of Block 792, then southward along that block limit line to the northeast corner of Block 792, Lot 1.05, then westward along the northerly lot lines of Block 792, Lots 1.05, 2.02, 3.02, 4.03, 5.03 and 20, to the municipal boundary of Cape May Point, then northward and westward along that boundary until it reaches the Delaware Bay, then northward along the Delaware Bay coast until it intersects with the beginning point at the Cape May Canal and the Delaware Bay, except that those lots designated as being within the Industrial District are not included in the R-1 District. Also excluded from the R-1 District are those lots which are designated as being within the Conservation District. Additionally, the R-1 District shall include those portions of Block 740, Lots 1.02 and 2 situate between the Cape May Canal and a line commencing at a point situate in the southwesterly line of Bayshore Road 1,500 feet from the intersection of the said southwesterly line of Bayshore Road and the southerly line of Lincoln Boulevard, and ending at a point in the line separating Lots 1.02 and 1.03 in Block 740, 1,600 feet from the intersection of the said line separating the said lots with the southerly line of Lincoln Boulevard.
(b) 
The R-1 District near the intersection of Bayshore and Fishing Creek Roads consists of Block 494.01, Lots 4.01 and 4.02.

(4) 
Conservation District (backbays and marshes). The Conservation District east of the Garden State Parkway includes the area bounded by a line beginning at the intersection of the southbound lane of the Garden State Parkway and the Lower-Middle Township boundary line, and running eastward along that line to Richardsons Channel, then southward to Shaw Cutoff and eastward to the Lower Township-Wildwood Crest boundary, then southward along that boundary to the southernmost point of Sunset Lake, then along the southeasterly line of Lot 1 of Block 820 to Jarvis Sound, then southward along the edge of Jarvis Sound to Lower Thorofare, then continuing southward to Middle Thorofare, then northward to the northeast corner of Lot 15.06 of Block 793, then westward along the northerly lines of Lots 15.06 and 15.07 of Block 793 to the northwest corner of said lot 15.07, then southward to its intersection with Ocean Drive, then westward along Ocean Drive to the southeast corner of Lot 12.02 of Block 793, then along the easterly edge of said lot 12.02 to the southwest corner of Lot 10, Block 793, then northward along the westerly edge of said Lot 10 to Mill Creek, then westward along Mill Creek to its intersection with the southbound lane of the Garden State Parkway, then northward along said southbound lane to the point of origin (where it intersects the Lower-Middle boundary). Lot 10, Block 793 shall be included in the Conservation District. The Conservation District also includes Block 790, Lots 5, 6, 7, 8 and 9, and Block 748, Lots 29.02, 34.01 and 34.02.
(5) 
South Cape May Conservation District.
(a) 
The South Cape May Conservation District comprises that area bound on the south by the Atlantic Ocean, on the west by the municipal boundary of Cape May Point, on the north by the northerly lot lines of Block 792, Lots 20, 5.03, 4.03, 3.02, 2.02 and 1.05; from the northeast corner of Block 792, Lot 1.05, the boundary follows the block limit line northward to Sunset Boulevard, then eastward until it intersects the boundary of West Cape May; the easterly boundary is then formed by the municipal boundaries of West Cape May and Cape May, running between Sunset Boulevard and the Atlantic Ocean. The following blocks and lots are also a part of the South Cape May Conservation District: Block 748, Lots 1.02, 1.03, 28.03, 29.02, 30.33, 34.01, 34.02, 34.03, 35.01, 35.02, 35.03, 38 and 39. Block 790, Lots 1-4, 5.01, 5.02, 6, 7.01, 7.02, 8 and 10.
(b) 
The Conservation District along Fulling Mill Stream consists of the area within a boundary formed by a line beginning at the point where the Lower Township-Middle Township boundary meets the Delaware Bay, then eastward along that municipal boundary to the northwest corner of Block 409, Lot 19.01, then southward along the westerly line of that lot to its southwest corner, then eastward to the northwest corner of Block 409, Lot 18.01, then southward along the westerly lines of Lot 18.01, 17.01 and 17.04 of Block 409, to the southwest corner of Lot 17.04, then southeastward along the boundary of Lot 17.04 to the northern boundary of the Cape May County Airport, to the northwest corner of Lot 16, then southerly to the northeast corner of Lot 5.06, then northwestward to the northwest corner of Lot 5.06, then westward to the southwest corner of Lot 5.06, then continues westward along Fulling Mill Road to the southwest corner of Lot 5.01, then northward along the westerly edge of Lot 5.01 to the northeast corner of Lot 5.05, then following the westerly edge of Lot 4 northward, and continues northward along the westerly edge of Lot 1 until it reaches the northeast corner of Pensacola Road, then westward, parallel to Miami Avenue, at a distance of 100 feet north of Miami Avenue, until it intersects the easterly edge of Block 5, then northward then westward along the perimeter of Block 5, then straight across Bayshore Road and along the southerly edge of Block 1 to an imaginary point formed by the northward extension of the western edge of Block 3, Lot 1.02 (the Millman Center), then southward along that imaginary line until it reaches the southern edge of Block 3, then westward along that edge until it reaches the southeast corner of Block 10, Lot 3, then northward along the easterly edges of Lots 1, 2 and 3 of Block 10 and continuing northward along the imaginary line formed by extending those easterly lot lines until it would intersect the southerly edge of Block 1, then westward along that edge until it reaches the Delaware Bay, then northward to the point of beginning (the Lower-Middle boundary).

(c) 
The Conservation District located along the Cape May Canal and south of the Cape May Canal, being comprised exclusively of lands owned by the United States of America and the New Jersey Department of Environmental Protection, shall consist of the following blocks and lots: Block 740, Lot 1.06; Block 746, Lot 8; Block 747.01, Lot 14; Block 748, Lots 1.01, 2.01, 2.02, 3.02, 3.03, 5.01, 5.05, 16.01, 24.02, 25.01, 25.02, 26.02, 28.03, 28.05, 34.04, 36 and 37; Block 753.01, Lots 39.01, 39.05 and 42; Block 753.04, Lot 42; Block 790, Lot 9; Block 792, Lots 12, 13, 14, 15, 17, 18 and 19.
(d) 
The Conservation District near the intersection of Bayshore and Fishing Creek Roads consists of Block 494.01, Lots 3, 1.04, 24 and that portion of Lot 28 lying westward of an imaginary line formed by the northward extension of the westerly edge of Lot 1.03.

(e) 
The Conservation District located adjacent to the Cape May-Lewes Ferry shall consist of all property contained in Block 740, Lots 1.05, 12, 13 and 14 and Blocks 692, 693, 694 and 695 on the Tax Map of the Township of Lower.

(6) 
MGB District. The MGB District comprises that area bound by a line beginning at the point where Spicers Creek intersects the canal, then traveling southward parallel to Wissahickon Avenue and Wilson Drive to Cape Island Creek, then following the shoreline of Cape Island Creek around to the northeast corner of Block 824.02, Lot 16, then westward along the northerly boundaries of Lots 16, 14 and 13 of Block 824.02 to the northwest corner of Lot 13, Block 824.02, then northward along the westerly edge of Block 824.02, Lot 6, to the northeast corner of Block 824.02, Lot 7, then westward along the northerly lot line of said lot to its intersection with US Route 109, then northward along Route 109 to the canal, then westward along the canal to the beginning point (where the canal and Spicers Creek intersect).
(7) 
R-3 District.

(a) 
The Erma R-3 District includes the area within a boundary beginning at Cresse Lane and the railroad right- of-way and traveling northward along that right- of-way to the Middle Township municipal boundary, then eastward along that line to the southbound lane of the Garden State Parkway, then southward along the parkway to the northeasterly edge of Block 507.01, then westward along that edge and following that perimeter southward then westward again until it intersects the easterly edge of Lot 6 ( Block 507.01), then southward along that edge to Cresse Lane, then westward along Cresse Lane to the beginning point.
(b) 
The Villas, Town Bank and North Cape May R-3 District includes the area within a boundary line beginning at the point where the southerly edge of Block 1 intersects the Delaware Bay and goes southward along that waters edge to Lincoln Boulevard, then eastward along that road to the westerly edge of the North Cape May GB-1 District, then northward, then eastward, southward and eastward along that boundary until it reaches the southeast corner of Lot 2.05 of Block 741.01, then northward along the easterly edge of that lot and continuing northward along the westerly edge of Block 499.01 and still continuing northward along the westerly edge of Lot 15 of Block 496.01 to its northernmost point, then westward along the southerly edge of Lot 19 of Block 496.01 to Bayshore Road, then northward along Bayshore Road to the southeast corner of Lot 17.02 of Block 494.01, then westward and northward along its edges to its intersection with Lot 15, then westward along its southerly edge to its intersection with the westerly edge of the Beerworld R-1 District, then northward and eastward along that district boundary to Bayshore Road, then southward along Bayshore GB District, then eastward along that boundary to Breakwater Road, continuing eastward along Breakwater Road to the westerly edge of the Airport Industrial District, then northward along that district boundary to Fulling Mill Road, then westward along Fulling Mill Road to its GB District boundary, then southward and westward along that district boundary, and continuing southward along the GB-1 District boundary and the GB District boundary in the vicinity of Township Hall, then westward and northward along the southerly and westerly GB and GB-1 District boundaries to the southerly edge of the Conservation District, then westward along that district boundary to the beginning point.
(c) 
The Kechemeche II R-3 District includes those areas within a boundary line beginning at the southwest corner of Lot 1 of Block 496. 06 and going eastward along the edge of Block 496.01 to the southernmost point of Lot 2 of Block 496. 08, then northward along the edge of Block 496.01 to Mickels Run, then westward along Mickels Run to Bayshore Road, then southward along Bayshore Road to the beginning point. The following blocks and lots shall be added to this zone: Block 496.01, Lot 26.03; Block 496.29, Lots 1-7, 28-33, 68, 71-85, 87-119, comprising the Mickel's Run Subdivision.
(d) 
The R-3 District covering the northwest portion of the Villas is bounded by the Conservation District to the north and east, and by the GB and GB-1 District to the south and west.
(8) 
R-2 District. The R-2 District includes all those areas not included in the other districts.
(9) 
R-4 District.

(a) 
The R-4 District encompasses all those lands lying within a boundary line which begins at the northernmost corner of Lot 2.03 of Block 820 and travels southwestward along the southeastern line of Lot 1 of Block 820 until it intersects with an imaginary line formed by the extension of Madison Avenue into the marshes; the boundary then travels southeastward along that line and along Madison Avenue to within 120 feet of Pacific Avenue; it then turns to the northeast and runs parallel to Pacific Avenue, 120 feet to the west of it, until it intersects the Wildwood Crest municipal boundary; the line then follows that boundary northwestward and then northeastward to the easternmost corner of Lot 2.03 of Block 820, then follows the northeasterly line of that lot back to the point of beginning, which is the northernmost corner of that lot; and Blocks 698, 703, 708, 713, 718, 723, 728 and 733. The R-4 District shall also include Block 820, Lots 2.04 and 2.05. The new lots within Block 820 that shall be located within the R-4 zone are Lots: 2.20, 2.21, 2.22, 2.23, 2.24, and 2.04.
(b) 
The Tranquility Park R-3 District includes the area within a boundary line beginning where the Route 109 bridge crosses the canal and going westward along the canal to the railroad right-of-way until its intersection with Ferry Road, then eastward along Ferry Road to Route 109, and continuing eastward along Route 109 until its intersection with the easterly edge of Lot 1, Block 753.05, then southward along that edge to Portsmouth Road, then eastward along that road until it intersects 11th Avenue, then southward along that road to 8th Avenue, then eastward along 8th Avenue to Wissahickon Avenue, then southward along Wissahickon Avenue to 7th Avenue, then eastward along 7th Avenue to Route 109 to the beginning point. The R-3 District shall include Block 753.01, Lot 39.03; Block 753.05, Lot 1; Block 773, Block 774 and Block 775.
(c) 
The GB District along the Route 109 curve consists of the area bounded by a line beginning at the northeast corner of Lot 1, Block 753.05, running southward along the easterly boundary of that lot to its intersection with Portsmouth Road, then eastward along Portsmouth Road to 11th Avenue, then southward to its intersection with 8th Avenue, then eastward along 8th Avenue to its intersection with Wissahickon Avenue, then southward along Wissahickon Avenue to 7th Avenue, then eastward along 7th Avenue to US Route 109, then northward and around the bend westward to the point of beginning. This GB District shall not include Block 753.01, Lot 39.03; Block 753.05, Lot 1; Block 773, Block 774 and Block 775.
(10) 
R-6 District. The R-6 District is comprised of all lands between the US Coast Guard Electronics Center and the Wildwood Crest municipal boundary which are east of Pacific Avenue, with the exception of Blocks 698, 703, 708, 713, 718, 723, 728 and 733.
(11) 
GB-1 District.

(a) 
The Diamond Beach GB-1 District includes those lands west of Pacific Avenue, between Madison Avenue and the Wildwood Crest municipal boundary, which are within 120 feet of Pacific Avenue.
(b) 
The North Cape May GB-1 District encompasses Block 690; Block 673, Lots 8, 9, 11 through 17; Block 655, Lots 6 and 24 through 27; those lots in Blocks 628, 629 and 630 which front on Bayshore Road; Block 494.03, Lots 1, 19.02, 19.03, 19.04; Block 628, Lots 101-107 and 134, and that portion of Lot 19.01 which is within 125 feet of Bayshore Road; Block 499.02, Lots 33.01, 33.02 and 33.13; and Block 741.01, Lots 1.01, 1.02, 2.01, 2.02, 2.03, 3, 28.02, 28.03 and that portion of Lot 28.01 lying to the west of an imaginary line formed by extending the easterly boundary of Lot 3 in a southerly direction.
(c)

(12) 
GB-II District. All property fronting upon Bayshore Road on the east side from Block 410.01, Lots 59.02 and 64.02 to Block 5, Lots 1, 7, 8, 9, 10 and 11 and all property fronting upon Bayshore Road on the west side from Block 349.10, Lot 5 to Block 3, Lot 1.01 shall be classified as zone GB-II.
(13) 
GB District.

(a) 
The GB District abutting the northbound lane of the Garden State Parkway consists of Lots 11.01, 11.02, 11.03 and 12.02 of Block 793.
(b) 
The GB District at the intersection of Shunpike and Ferry Roads consists of Lots 12.02, 13.01, 13.02, 13.03, 13.04, 13.05, 13.06, 13.07 and 14 of Block 741.01.
(c) 
The GB District at the intersection of Breakwater and Bayshore Roads consists of Lots 13.01, 13.02, 14, 15 and 16 of Block 495.01; and Block 496.01, Lots 24.01, 24.02, 25, 26.01 and 26.02 and Block 496.29, Lot 86.
(d) 
The GB District abutting Bayshore Road and lying to the west of it, near and below Mickels Run consists of Block 494.01, Lots 13.01 and 13.02, 17.01 and 17.02, and the portions of Block 494.01, Lots 14, 15, 16.02 and 16.03 which are within 200 feet of Bayshore Road.
(e) 
The GB District in the vicinity of Township Hall consists of Block 368.03, Lot 9.01; Block 349.10; Block 410.02; Block 334.17, Lots 1 and 2; Block 368.04, Lot 28; Block 410.01, Lots 59.03, 63.02, 63.03, 63.04, 64.01, 64.02; and the portion of Lot 59.02 which is within 200 feet of Bayshore Road.
(f) 
The GB District along Fulling Mill Road consists of Block 173, Lots 18 through 26; Block 193, Lots 9 through 15 and 22 and 23; Block 194, Lots 1 through 5; Block 207, Lots 9 through 20; Block 208; Block 252, Lots 4 through 20; Block 255, Lots 81.01, 81.05, 81.06 and 81.07; Block 409, Lots 5.02, 5.03, 5.04, 6 and 7; Block 410.10, Lots 12 and 13; Block 410.16, Lots 1 and 18; Block 410.20, Lots 1 and 14; and Block 410.22, Lots 1 and 6.
(g) 
The GB District at the intersection of Bayshore and Fishing Creek Roads consists of Block 494.01, Lots 5, 6.01 and 6.02.
(14) 
RB District. The RB District encompasses the area bounded by a line beginning at the point where Cresse Lane and Route 9 intersect and going westward along the northerly edge of Lot 21.01 of Block 410.01 to the unnamed road, then southward along that road to its southwesternmost corner, then continuing southward along an imaginary line extending from that point to the southwesterly corner of Lot 29.01 of Block 410.01, then westward then southward along the perimeter of Block 433 to Breakwater Road, then eastward along Breakwater Road to May Avenue, then southward along May Avenue to the northwest corner of Lot 12.01 of Block 500.01, then southward along the westerly edges of Lots 12.01, 12.02, 12.03, 12.04, 12.05, 11/02, and 16, then continuing straight across Weeks Landing Road and parallel to Seashore Road at a distance of 300 feet westward of that road to the point where it intersects with an imaginary line formed by the westward extension of the northeasterly edge of Block 500.01, Lot 40, then southeastward along that line to the railroad right-of-way, then southward along that right-of-way to the southwest corner of Block 504, Lot 7, then southeastward along its southwesterly edge and continuing to the intersection of the said southwesterly edge and the northwesterly line of Route 9, then northeastwardly along the said northwesterly line of Route 9 to its intersection with a dividing line between Lots 5.01 and 6 in Block 5.04, then eastward across Route 9 and along the southerly edge of Lot 19 of Block 510 for a distance of 250 feet, then northward to the easterly edge of Lot 20, then along that edge and along the easterly perimeters of Lots 21.01 and 4.03, then from the easternmost point of that lot to the easternmost point of Lot 4.04 and continuing northward along with easterly edges of Lots 24.02, 24.04, 24.05, 24.06 and 24.07 to the access easement, then westward along that easement to Route 9, then northward along Route 9 to the beginning point (at its intersection with Cresse Lane).
(15) 
Industrial District. The Airport Industrial District includes the area within the boundary formed by a line beginning at the northwest corner of Block 409, Lots 19.01, and following the Lower Township-Middle Township boundary eastward until it reaches Shunpike Road, then southward along Shunpicke Road to the southwest corner of Lot 11.01 of Block 410.01, then eastward along its southerly edge to Lot 9.01, then southward along the easterly edges of Lots 11.02, 19, 30.01 and 32 to the southeast corner of Lot 32, then westward along its southerly edge of Nummy Town Road, then southward along that road until it intersects Weeks Landing Road, then westward, southward, westward again, and northward around the perimeter of Lot 5 of Block 500.01 to the southeast corner of Lot 55 (Block 500.01), then westward along the southerly edge of Lot 55 to Shunpike Road, then northward along that road until it intersects Breakwater Road, then westward along Breakwater Road to the southwest corner of Lot 36 of Block 410.01, then following the easterly edge of Lot 36 and going northwestward around the edge of Lot 38.02 to the southerly edge of Lot 38.01, then following that edge northwestward to the southernmost point of Lot 38.04, then northward along the westerly edge of that lot then eastward along its northerly edge to the southeast corner of Lot 65.01, then northward along the easterly edge of that lot to its northerly edge, then westward along that edge to the southwest corner of Lot 67, then northward along the westerly edges of Lots 67, 73, 72.03, 74, 75 and 76, then eastward along the southerly edge of Lot 78 to the westerly edge of Lot 79, cross over Fulling Mill Road to the southwest corner of Lot 5.06, Block 409, then northeastward to the northwest corner, then southerly along its northern edge to the northeast corner of Lot 5.06, Block 409, then northward to the northwest corner of Lot 16 of Block 409, then along the northerly boundary of that lot to the easternmost point of Lot 15.01, then westward along the southwesterly edge of Lot 1704, then northward along the westerly edges of Lots 17.04, 17.01 and 18.01 to the southerly edge of Lot 19.01, then westward and northward along the edge of that lot to the point of beginning (where its westerly edge intersects the municipal boundary).

Industrial - Special Purpose Zone. The Industrial - Special Purpose Zone consists of Block 410.01, Lots 36, 37, and 37.01.

MD-1 District. The MD-1 District includes that area commonly known as "Shawcrest," which is bounded by Richardsons Channel on the west, Shaw Cutoff on the south, Grassy Sound on the east, and the Middle Township municipal boundary on the north.

The MD-2 District includes the area comprised of Block 793, Lots 15.01, 15.02, 15.03, 15.04, 15.05, 15.06 and 15.07; Block 820, Lots 3.01, 3.02, 3.03, 4.02, 5.02, 8.01, 8.02 and a portion of Lot 2.01 lying westerly of an imaginary line that would exist if Madison Avenue were extended northwestward into the marshes; Block 821, Lot 2; Block 822.01, Lots 1.01 and 1.02; Block 822.02, Lots 2, 3, 4, 5 and 6; Block 822.03, Lots 7.01, 7.02, 8, 9, 10, 11 and 12; and Block 823, Lot 1.

R-6/H District. The R-6/H District shall consist of all the lots oceanward of the center line of Atlantic Avenue and the center line of vacated Atlantic Avenue from its starting point where the center line of Atlantic Avenue intersects the Wildwood Crest border to the north, thence, in a southward direction until that point where the center line of Atlantic Avenue terminates at the Conservation District boundary line.

GB-1 Cannabis Overlay Zone. The Cannabis Overlay Zone shall be located within the GB-1 Zone and same is specifically confined to Block: 690, Lots: 1.01 and 1.02 and Block: 741.01, Lot: 28.01.

Zoning district boundary lines are intended to follow street center lines, railroad rights-of-way, streams and lot or property lines as they exist on lots of record at the time of enactment of this chapter unless otherwise indicated by dimensions on the Zoning Map. Any dimensions shown shall be in feet and measured horizontally and, when measured from a street, shall be measured from the street right-of-way line even if the center line of that street is used for the location of a zoning district line. The exact location of any disputed zoning district boundary line shall be determined by the Board of Adjustment. The zoning standards, controls and designations apply to every structure, lot and use within each district, and the district lines extend vertically in both directions from ground level.
Where a zoning district boundary line divides a lot other than by following a stream or street, any use permitted in either district may be extended not more than 20 feet into the adjacent district. A use permitted in the zoning district so extended shall thereafter be a permitted use in the extended area. A zoning district line, however, shall be altered only once by utilizing this section of the chapter after which the lot use shall be governed by the regulations of the zoning district in which it is located after the zoning district boundary line adjustment.
