A.Â
It shall be unlawful for any parent, legal guardian or
other person having the care and custody of a minor child under 18 years of
age to encourage, contribute toward, to cause or tend to cause said child
to become delinquent by any act or word, or failure to act or by the lack
of supervision and control over the minor child.
B.Â
It shall be unlawful for any parent, legal guardian or
other person having the care and custody of any minor child under the age
of 18 years to assist, aid, abet, allow, permit or encourage the minor to
violate the provisions of any ordinance of the Township or statute of the
State of New Jersey either by overt act, by failing to act or by lack of supervision
and control over the minor child.
As used in this chapter, the following terms shall have the meanings
indicated:
Any violation of the municipal ordinances of the Township or any
state statute.
The exercise of control over a minor child, knowing his whereabouts,
knowing with whom he associates and what activities he or she may engage in
which could affect or offend the public peace, safety and morals.
Any person under the age of 18 years apprehended for the violation of any municipal ordinance of the Township or any law of the State of New Jersey shall be brought forthwith before a judge of the Juvenile Division of the Cape May County Juvenile and Domestic Relations Court, and upon the court's determination that the minor is a delinquent the parent, legal guardian or other person having care and custody of the minor child shall be summoned before a judge of the municipal court of the Township in order to provide supervision of the minor child. After this proceeding, if the minor child in question is again judged delinquent by a judge of the Juvenile Division of Cape May County Juvenile and Domestic Relations Court, then the parent, legal guardian or other person having care and custody of the minor child shall be subjected to the penalties in Chapter 1, Article III, General Penalty.
