A. 
Private premises. It shall be unlawful for any person to deliver or deposit, or for any person, firm or corporation to cause the delivery or deposit of, any unsolicited newspaper, shopper, circular, leaflet, flyer or other like printed matter to or upon any private premises within the Township of Lower except in accordance with the terms hereof. For the purpose of this chapter, "unsolicited" shall mean the printed matter referred to herein has not been ordered, subscribed to or requested by the recipient.
B. 
Public places. No person shall throw or deposit, nor shall any person, firm or corporation cause the delivery or deposit of, any newspaper, shopper, circular, leaflet, flyer or other like printed matter to or upon any sidewalk, street or other public place within the Township of Lower; provided, however, that it shall not be unlawful to hand out or distribute any such matter to persons willing to accept same.
Unsolicited printed matter set forth in § 493-1A shall be delivered to private premises as follows:
A. 
By placing such matter within a permanently installed appurtenance to the premises designed and designated for the receipt of such printed matter; or
B. 
If there is no such designated appurtenance for the receipt of printed matter, delivery shall be made by placing such matter on the ground or floor at a point not less than five feet from any street.
There shall be no delivery whatsoever of any unsolicited printed matter to:
A. 
Any private premises where the owner, tenant, or other person in control of such premises has notified the publisher, distributor or delivery person that such delivery shall cease or be suspended for a stated period of time; or
B. 
Any private premises which is clearly or conspicuously posted with a sign prohibiting trespassing, soliciting or advertising.
Any person, firm or corporation convicted of a violation of any provision of this chapter shall be subject to a fine of not less than $100. Each delivery in violation of the terms hereof shall be deemed a separate offense.
