The Council of the Municipality of Murrysville and its authorized agents, servants or employees are empowered as follows: to enter upon any lands or enclosures to cut, open, clean, maintain, repair or replace any bridges, culverts, basins, pipes, drains, ditches, watercourses or other stormwater drainage collection channels or systems on, in, under, along or traversing in any manner the roads located within the Municipality; and to enter upon any lands or enclosures to cut, open, clean, maintain, repair or replace any drains, ditches, watercourses, pipes, basins or other stormwater drainage collection channels or systems on, in, under, along or traversing said lands or enclosures, if, in their judgment, any of the above-mentioned actions are necessary to carry water from the roads located within the Municipality or to prevent stormwater from overflowing the roads located within the Municipality or to prevent stormwater from overflowing any lands abutting said roads or to otherwise assure the continuous and uninterrupted flow of stormwater on, in, under, along or traversing in any manner the roads, lands and enclosures located within the Municipality.
No person, partnership, organization or corporation shall stop, fill up or injure any such culvert, basin, pipe, drain, ditch, watercourse or any other stormwater drainage collection channel or system, or divert or change the course thereof, or permit the same to be stopped, filled up or injured, or permit the course thereof to be diverted or changed without the authorization of the Council of the Municipality of Murrysville or its authorized agents, servants or employees.
Any person, partnership, corporation or organization who shall stop, fill up or injure any such bridges, culverts, basins, pipes, drains, ditches, watercourses or other stormwater drainage collection channels or systems, or shall divert or change the course thereof, or, by his conduct, permit the same to be stopped, filled up or injured, or shall permit the course thereof to be diverted or changed without the authority of the Council of the Municipality of Murrysville shall, upon conviction thereof in a summary proceeding, pay a fine of not less than $100 and not more than $300 or such other maximum sum as may be provided by statute. In default of payment of the fine, each person, the members of such partnership or organization, or the officers of such corporation shall be liable for imprisonment for not more than 60 days. Each day that a violation is continued shall constitute a separate offense. All fines collected for violation of this chapter shall be paid over to the municipal general reserve fund.
