Under provisions of § 3704 of the Third Class City Code,[1] a Recreation Commission is established for the City, to be composed as provided in § 3705 of the Third Class City Code.[2]

The Commission shall have such powers and duties as are set forth in Article XXXVII of the Third Class City Code.[1]

A. 
The position of Clerk to the Recreation Commission is hereby created.
B. 
Such Clerk shall be responsible to and work directly under the supervision of the Executive Director of the Recreation Commission.

The Recreation Commission is hereby confirmed and is empowered with the authority to equip, operate, supervise and maintain recreation places within the City and shall have all the powers and duties conferred upon it by the Third Class City Code.[1]

The Council shall annually make appropriation to the Recreation Commission.

A. 
The Recreation Commission shall be composed of nine members: seven shall be appointed by the Mayor with the approval of the Council; two shall be members of the Pottsville Area School District and appointed by the School Board. All members shall obtain a Pennsylvania Child Abuse History Clearance, a PA State Police Criminal History Check and a FBI Criminal History Record Information Check (fingerprints) and submit this documentation to the City prior to service on the Commission.

The term of office of members shall be five years, except that the terms of the members first appointed by this section shall be so fixed that the term of one of the members shall expire one year from the effective date of this section, the term of two members shall expire two years from the effective date (one being a School District appointment), the term of two members shall expire three years from the effective date (one being a School District appointment), the term of two members shall expire four years from the effective date, and the term of two members shall expire five years from the effective date. In the event of vacancies, City Council shall appoint a member to fill the unexpired term. Members whose terms have expired shall hold office until the successors have been appointed.
C. 
The members of the Recreation Commission shall elect their own Chairman and Secretary and shall elect all other necessary officers who shall serve for a period of one year.
