Garage and yard sales, as used in this article, shall mean occasional sales at retail, by residential owners or occupants, conducted in the garage, patio, driveway or yard of the residential premises occupied by the person holding the sale, for the purpose of disposing of surplus personal property accumulated incidentally in the regular course of residential occupancy.
Garage/yard sales shall be subject to the following restrictions, rules and regulations:
A. 
Such sales shall be conducted only by an owner or occupant of such residential premises where the sale is to be held, or by members of the household or family of such owner or occupant and no permit shall be issued to any person who holds himself out as being habitually in the business of selling such property at retail.
B. 
Such sales shall not exceed four in any one calendar year on the same premises, and shall not extend in duration for more than three consecutive days for any one sale.
C. 
No new merchandise acquired solely for the purpose of resale on the premises shall be sold at such occasional sales. Garage/yard sales shall be restricted to surplus personal property accumulated as an incident to residential occupancy of the premises.
D. 
Nothing herein shall prevent not more than three families cooperating in holding joint sales on the residential premises of any one of them provided all such joint participants are named in the application and permit, and only property permissible in a separate sale by each of such families is offered for sale.
E. 
Permit therefor shall be first obtained prior to the sale by applications that are available at the information desk at City Hall on forms provided by the City, at no cost.
F. 
The permit shall be displayed on the premises during the sale.
G. 
Signs are strictly prohibited from being located on utility poles. Signs may be displayed 48 hours prior to actual sale, and must be removed prior to 5:00 p.m. the last day of the permitted sale.
A. 
It shall be permissible to conduct garage/yard sales on residential-zoned premises in the City only pursuant to a permit first obtained City administrators office or his designated representative, and only in accordance with the rules, regulations and restrictions herein provided.
B. 
It shall be unlawful to conduct any garage/yard sale, as herein defined, within the city without a permit or in violation of any of the provisions of this article.
Any person, firm or corporation who or which shall fail, neglect or refuse to comply with any of the terms or provisions of this article or of any regulation or requirement pursuant hereto and authorized hereby shall, upon conviction thereof, be ordered to pay a fine of not more than $50.
