A.
OPEN (When used in connection with a container)
The following words or phrases, unless the context clearly
indicates otherwise, shall have the meanings ascribed to them in this section:
Any container which has been perforated in the case of a can or similar
container or a container on which the cap has been loosened or the cork displaced
and the official seal torn or mutilated.
It shall be unlawful within the Borough of Punxsutawney for any person
to drink liquor or malt or brewed beverages upon any public street, alley,
throughway or sidewalk or in any public municipal parking lot, private parking
lot open to public use, public park or on any property owned, controlled or
regulated by the Borough of Punxsutawney or in any vehicle being operated
or parked thereon.
It shall be unlawful within the Borough of Punxsutawney for any person to have in such person's possession or in a vehicle under such person's control any open container liquor or malt or brewed beverages upon any public street, alley, throughway or sidewalk or in any public municipal parking lot, private parking lot open to public use, public park or on any property owned, controlled or regulated by the Borough of Punxsutawney for the purpose of drinking said contents in any of the places prohibited in § 74-2 above.

Notwithstanding other provisions of this article prohibiting consumption
of liquor or malt or brewed beverages or possession of any open container
of liquor or malt or brewed beverages in certain places within the Borough
of Punxsutawney, such consumption or possession in otherwise prohibited areas
may be permitted in conjunction with special events sponsored by establishments
properly licensed by the Pennsylvania Liquor Control Board or its successor,
provided that advance approval is obtained from the Borough Council of the
Borough of Punxsutawney, which approval shall be subject to such conditions
as may from time to time be imposed by the Borough Council relative to such
special event.

Any person violating any provision of this article, upon conviction
before the District Justice, shall be guilty of a summary offense and shall
be subject to a fine of not less than $25 nor more than $300, plus costs of
prosecution, or to undergo imprisonment for a term not exceeding 90 days,
or both.
