As used in this chapter, the following words and terms shall have the
meanings hereby ascribed to them, except where the context clearly indicates
a different meaning:
CHILD
A person under the age of 18 years, whether a resident or a nonresident
of the Borough of Punxsutawney.
OFFICIAL BOROUGH TIME
Eastern standard time, except that from the last Sunday in April
to the last Sunday in October it shall be Eastern daylight saving time.
PARENT
Any parent, guardian or any adult person responsible for the care
and custody of a child.
REMAIN
To loiter, idle, wander, stroll or play in or upon.
It shall be unlawful for any child who has not reached his or her 18th
birthday to be or remain in or upon any public highway, park, playground,
street or other public place or in any vehicle which is in or upon any of
the aforesaid public places between the hours of 12:00 midnight and 5:00 a.m.,
official Borough time, unless accompanied by a parent or unless such child
is lawfully employed so as to make it necessary to use public highways during
such time for the exclusive use of such employment.
It shall be a defense to a violation of this chapter if the offender
shall present proof that he or she was in attendance at an unauthorized school
event of the Punxsutawney area school or Punxsutawney parochial school which
concluded less than 1/2 hour before he or she was apprehended.
The Mayor, with the approval of the Public Safety Committee, may, from time to time, issue proclamations or notices temporarily suspending this chapter, or extending the hour of the same so as to permit children who have not reached their 18th birthday to be upon the streets or in or upon other public places for any special occasions or functions not otherwise covered in §
105-3.
