The purpose of this chapter is to prevent public and private nuisances
caused by fires deliberately or carelessly set and maintained; and to avoid
unnecessary calls and false alarms to the Punxsutawney Fire Department.
Certain words and phrases shall have the meaning ascribed to them, as
follows:
Any fire in an incinerator, fireplace designed for outdoor cooking,
or a fireproof container.
Any fire set or maintained inside or outside of a building.
Any individual, partnership or corporation.
Any fire except a contained fire.
A.
No uncontained fire shall be set or maintained within
20 feet of any building or property line.
B.
No uncontained fire shall be set or maintained on any
public road or public property.
C.
No fire shall be set or maintained that may endanger
any building or property.
D.
In no event shall any person be permitted to use a burn barrel or other similar receptacle to burn items set forth in § 128-3F.
E.
No fire shall be set or maintained which affects neighboring
properties by discharging obnoxious odors, dense smoke or fly ash.
F.
No fire shall be set or maintained for the purpose of
burning of materials releasing any quantities of obnoxious odors, dense smoke,
or fly ash or hydrocarbons such as garbage, plastic, tires, roofing materials,
and like items. Excepted from this restriction is conducting of approved training
sessions by the Punxsutawney Fire Department for the purpose of educating
fire fighters in the proper methods of fire fighting.
A.
Contained fires shall be only used to burn acceptable
combustible material.
B.
An outdoor furnace shall be considered an accessory structure as set forth in the zoning ordinances of Chapter 235 of the Code of the Borough of Punxsutawney and subject to the appropriate yard setback distances.
C.
A draft-induced blower may be installed on the vent stack
to create a positive draft.
A.
Any person, firm or corporation who shall violate any
provision of this chapter shall, upon conviction thereof, be sentenced to
pay a fine of not less than $50 nor more than $1,000 plus costs and, in default
of payment of said fine and costs, to a term of imprisonment not to exceed
30 days. Each day that a violation of this chapter continues shall constitute
a separate offense.
B.
The Code Enforcement Officer, officials of the Punxsutawney
Fire Department and members of the Punxsutawney Police Department shall have
the authority to enforce the provisions of this chapter.
