The Borough Council of the Borough of Punxsutawney, following due investigation, deems it appropriate to establish rules and regulations governing the use of Harmon Field and Patsy Dunmire Park in order to provide for the health, safety and welfare of recreational users of those facilities.
The following rules and regulations shall apply to the use of Harmon Field:
A. 
Littering is prohibited.[1]

The use of profanity is prohibited.
C. 
All persons are prohibited from riding skateboards.[2]

Glass containers are prohibited.

Smoking is prohibited.
G. 
Use of the park and its equipment shall be at the users' own risk.

Damage to or destruction of park property or equipment is prohibited.

The Borough Council shall cause the foregoing rules and regulations to be posted conspicuously at the public parks affected by this chapter, but the absence of posted rules shall not excuse liability for violations of the rules and regulations herein established.
A. 
To the extent that rules and regulations hereby established are already governed by provisions of the Crimes Code,[1] as amended and supplemented, or other state statute, prosecutions and penalties for violation thereof shall be in accordance with the laws and procedures then in effect relative to such violations and prosecutions therefor.

B. 
To the extent that rules and regulations hereby established are not governed by state statute, all persons violating such rules and regulations shall be guilty of a summary offense and, upon conviction, shall be sentenced to pay a fine not exceeding $300 or sentenced to a term of imprisonment for a period not to exceed 90 days, or both, together with costs of prosecution.

All tobacco is to be prohibited in all parks, playgrounds, squares, recreational facilities, pools and playing fields owned or operated by the Borough of Punxsutawney.
Appropriate signage shall be posted designating such areas as tobacco-free.

Each violation shall result in ejectment from borough property and a minimum fine of $25, maximum fine of $1,000.
