As used in this article, the following terms
shall have the meanings indicated:
A mechanical device which is designed to supplement the service
brakes of a vehicle by producing retarding torque about one of the
rotating components in a vehicle, converting kinetic energy to heat
and thereby retarding the forward motion of a vehicle, including but
not limited to:
An engine-brake retarder which converts a diesel
engine from a power-producing motor to a power-expanding air compressor
by changing the timing of the opening of the engine exhaust valves;
An exhaust-brake retarder which constricts the
flow of gasses through the manifold, increasing the system back pressure
and keeping the engine exhaust valves from closing at designated intervals;
or
A hydraulic-brake retarder which converts kinetic
energy to heat by sheaving a liquid with a rotating component inside
a chamber.
It is prohibited to use a brake retarder at
any time on the following streets or portions thereof:
A.
State Route 119, only from Segment 90 Offset 0000
(intersection with Gilpin Street) north through Punxsutawney to Segment
140 Offset 686 (intersection with Orchard Street SR 2017).
B.
State Route 310 (Elk Run Avenue) only from Segment
10 Offset 0000 (intersection with SR 119) and ending at Segment 20
Offset 269 within Punxsutawney Borough.
C.
State Route 36, only from Segment 230 Offset 0000
(the intersection with Elk Street) west through Punxsutawney Borough
to Segment 260 Offset 1205 (intersection with Ferry Street).
D.
State Route 2015, only from Segment 10 Offset 2202
(Orchard Avenue SR 2017) to the intersection with SR 310 (Elk Run
Avenue) at Segment 10 Offset 1326.
E.
State Route 2017, only from Segment 10 Offset 0000
(Orchard Street SR 119) to approximately Segment 10 Offset 480 (intersection
with SR 2015, Graffius Avenue).
F.
State
Route 436 (Lincoln Way) from the south side of Margiotti Bridge through
the intersection with State Route 36 (North Main Street).

The prohibitions in this article shall not apply
to a bona fide emergency driving situation which requires the immediate
use of a brake retarder to protect the safety of persons or property.
Each prohibited use of a brake retarder by a
person or persons shall be a separate violation of this article punishable
as a summary offense. Upon conviction, a fine of not less than $100
nor more than $1,000 per violation may be assessed, together with
costs of prosecution.
