The Borough of Ridley Park, in order to promote and protect the public health, safety, comfort, convenience and general welfare, hereby adopts the following chapter which implements the various regulations promulgated by the Delaware County Regional Water Quality Control Authority (DELCORA), the United States Environmental Protection Agency (USEPA) and the Pennsylvania Department of Environmental Protection (PADEP). The adoption of these regulations implement the Delaware County Wastewater Management Plan and the National Pretreatment Standards, 40 Code of Federal Regulations (CFR) 401 et seq., as required by federal law.
A. 
The Borough of Ridley Park hereby adopts and incorporates the DELCORA Standards, Rules and Regulations which govern all discharges to the DELCORA Wastewater Management System.[1]

Editor's Note: Ordinance No. 1076, adopted 12-10-1996, provided in part as follows: The DELCORA Standards, Rules and Regulations are amended as provided by DELCORA Res. Nos. 95-06 and 95-12. Ordinance No. 1076 further provided that the Eastern Area Local Limitations for discharge of wastewater as provided by DELCORA Res. No. 91-04 are adopted as the local limitations for all discharges of wastewater within the Borough of Ridley Park.
B. 
The DELCORA Standards, Rules and Regulations shall be the minimum standards and shall apply uniformly to each class or type of user within the Borough of Ridley Park.
C. 
The Borough of Ridley Park additionally intends to provide enforcement of the National Pretreatment Standards promulgated by the United States Environmental Protection Agency pursuant to the Clean Water Act, as amended, 33 U.S.C.A. § 1251 et seq.
A. 
The DELCORA Standards, Rules and Regulations which have been adopted by the Borough are as set forth in Appendix A and are incorporated and made a part of this chapter.[1]

B. 
The Borough of Ridley Park hereby establishes that any person, firm or corporation who fails or refuses to comply with the DELCORA Standards, Rules and Regulations which have been adopted by the Borough, and as may be amended from time to time, shall be subject to the penalties as are set forth herein.
C. 
The Borough of Ridley Park hereby appoints DELCORA or its designee as its agent having the power of the Borough of Ridley Park to institute proceedings in the name of the Borough of Ridley Park against any and all persons, firms or corporations who violate any provisions of this chapter.
D. 
In instances involving the enforcement of this chapter, the Solicitor of DELCORA or its designee may issue subpoenas for witnesses for the prosecution and may conduct the hearing on behalf of the Borough of Ridley Park.
Any person, firm or corporation who shall violate any part of this chapter shall be subject to pay a fine of up to $1,000 and/or, upon conviction thereof, be sentenced to imprisonment for a term not to exceed 30 days. Every day a violation of this chapter continues shall constitute a separate offense.
