As used in this chapter, the following terms
shall have the meanings indicated:
Every device having two tandem wheels and propelled by human
power, upon which any person may ride.
Every person propelling or riding a bicycle
upon the streets, alleys or public places shall be subject to the
provisions of all statutes of the commonwealth and ordinances of the
City applicable to the operation of any vehicle, except those provisions
with reference to equipment of vehicles and except those provisions
which, by their nature, would have no application.
No person shall ride a bicycle upon a sidewalk
within the City.
Bicycles shall be operated as close to the right-hand
curb as conditions will permit and not more than two bicycles shall
be operated abreast or side by side.
No person traveling upon any bicycle shall cling
to or attach himself or his vehicle to any other moving vehicle upon
any roadway.
The operator of a bicycle upon a street shall
not carry any other person upon the handlebar, frame or mud guard
of any such vehicle, nor shall any person so ride upon any such vehicle.
During the period from sunset to sunrise, every
bicycle shall carry one lighted lamp exhibiting a white light visible
from a distance of 500 feet to the front of such bicycle, and a red
reflector button or a red light to be placed at least six inches below
the seat at the rear. Such lamp or reflector shall, at all times,
be unobstructed.
Every bicycle shall be equipped with a horn
or bell in good working order and capable of emitting sound audible,
under normal conditions, for a distance of 200 feet; but no horn or
warning device shall emit an unreasonably loud or harsh sound. No
bicycle shall be equipped with a siren or whistle.
A rental agency shall not rent or offer any
bicycle for rent unless the bicycle is licensed and a license plate
is attached thereto as provided in this chapter, and such bicycle
is equipped with the lamps and other equipment required in this chapter.
Every person engaged in the business of buying
or selling new or secondhand bicycles shall make a report to the Director
of the Department of Public Safety of every bicycle purchased or sold
by such dealer within three days after the transaction, giving the
name and address of the person from whom purchased or to whom sold,
a description of such bicycle by name or make, the frame number thereof
and the number of the license plate, if any, found thereon.
Whoever violates any of the provisions of this
chapter shall, upon conviction, be fined not more than $5 or suffer
removal and detention of the license plate from his bicycle for a
period of not more than 30 days or suffer impounding of his bicycle
for a period of not more than 30 days or any combination of these
three penalties.[1]
