A.
No person shall park, or permit to stand, any vehicle,
whether attended or unattended, upon a street or highway within the
City in any of the following places:
(1)
Within an intersection.
(2)
On a crosswalk.
(3)
Between a safety zone and the adjacent curb, or within
30 feet of points on the curb immediately opposite the ends of a safety
zone, unless local officials shall indicate a different length by
signs or markings.
(4)
Within 25 feet from the intersection of curblines
or, if none, then within 15 feet of the intersection of property lines
at an intersection of streets or highways.
(5)
Within 30 feet upon the approach to any official,
flashing signal, stop sign or traffic signal located at the side of
the roadway.
(6)
Within 15 feet of the driveway entrance to any fire
station.
(7)
Within 15 feet of a fire hydrant.
(8)
In front of a private driveway.
(9)
On a sidewalk.
(10)
Alongside any street or highway excavation or
obstruction or opposite the same, unless a clear and unobstructed
width of not fewer than 20 feet upon the main-traveled portion of
the street or highway shall be left free for passage of other vehicles
thereon.
(11)
On the roadway side of any vehicle stopped or
parked at the curb or edge of the street or highway.
(12)
At any place where official signs have been
erected prohibiting standing and parking.
(13)
Within 50 feet of the nearest rail of a steam
or interurban railway crossing.
B.
Except when necessary in obedience to traffic regulations
or traffic signs or signals or where angle parking is permitted, the
operator of a vehicle shall not stop, stand or park such vehicle on
the street or highway within a business or residence district other
than parallel with the edge of the street or highway, headed in the
direction of traffic and with the curb side of the vehicle within
six inches of the edge of the street or highway or curb. Vehicles,
which because of type or construction cannot load or unload parallel
to the curb, shall be exempt, while loading or unloading only, from
the requirements of standing parallel to the curb.
No person shall park a vehicle in any public
court or alley. However, a commercial motor vehicle may load or unload
there but shall not obstruct other vehicles from passing.
No person shall park a motor vehicle upon the
street or highway in front of any store or building for the purpose
of loading or unloading merchandise if there are adequate facilities
therefor in the rear of any such store or building.

The City of Scranton is authorized to establish loading/unloading

abandoned and may be tagged or removed under the direction and in

No person shall park a motor vehicle upon the
street or highway closer than a distance of two feet from an other
vehicle parked in front thereof.
No person shall park a vehicle in front of the
entrance of any theater, public building, dance hall, driveway, either
public or private, or building in which a large number of people are
accustomed to gather, except if the same is designated as a parking
space by appropriate signs or markers.
No person shall park a vehicle upon any street
or highway for any greater length of time or contrary to any regulations
indicated by posted signs or other markers.
No person shall park or stand a vehicle upon
the street or highway for the purpose of making repairs thereto.
A.
The Department of Public Safety is hereby authorized
to erect signs prohibiting parking during certain hours on certain
streets for the purpose of street cleaning in accordance with a schedule
to be established by the Director of the Department of Public Works.
B.
When signs are erected giving notice thereof, no person
shall park a vehicle at any time in which parking is prohibited as
provided on such signs.
C.

B.
In the case of nonpayment of such fine or fines, and in addition
to all other penalties, fines, fees and enforcement measures permitted
by law, the person so violating the provisions of this article may
be imprisoned for not more than 10 days.
C.
The fines provided for in § 439-26A (Citation rates) shall be subject to adjustment pursuant to the following procedure:
(1)
Until December 31, 2016, the citation rates shall be as set forth
above and on the Schedule of Citation Rates described in Exhibit A,[1] which is attached hereto and incorporated herein. The columns labeled as "calculated value" on the Schedule of Citation Rates reflect annual increases of 3% (year-over-year) in the citation rates (assuming base rates of $25, $35, and $55, respectively). On January 1 of each calendar year, the Schedule of Citation Rates shall be updated in the event that the annual percentage change in the index (as defined below) exceeds 3%, as measured by a comparison of the index from the month of June, two calendar years prior to the calendar year in question to the index for the month of June of the calendar year immediately prior to the calendar year in question, by increasing the calculated value figure for the calendar year in question by the percentage change in the index. After updating the Schedule of Citation Rates in accordance with this § 439-26C, if necessary, on January 1 of each calendar year, the citation rates for that particular calendar year shall equal the amount set forth in the columns labeled as "established rate" on the Schedule of Citation Rates if the calculated value for that particular year exceeds the established rate for the calendar year immediately preceding the particular calendar year. If said calculated value is less than said established rate, then the citation rates for the calendar year in question shall be equal to the citation rates for the calendar year immediately preceding the calendar year in question. A Schedule of Citation Rates updated pursuant to this § 439-26C shall be maintained in the City Clerk's Office. Notwithstanding the foregoing, the citation rates shall not be increased for any given year unless the metered parking rates set forth in Council File No. 91, 2002, as amended, have also been increased for such year pursuant to the procedures set forth therein.

A.
No person shall park a motor vehicle in a space upon a street, highway
or entrance, private or public, which is designated for the use of
disabled or handicapped parking either with signage or markings showing
such space is for the use of handicapped parking. Said areas are exclusively
restricted to individuals who are disabled or handicapped and whose
license plate or designated placard so indicates or also who properly
displays a temporary handicap placard on the right front area of the
dashboard.
B.
In case of nonpayment of a fine assessed under this section, the
person so violating the above provisions shall be issued a citation/summons
within 45 days from the date of the identification of the violator.

C.
Renewal procedure for handicapped parking sign(s).
(1)
Any vehicle owner who has procured a handicapped parking sign must
file a renewal application with the Scranton Police Department and
pay a fee of $10 for a processing fee payable to the City Treasurer;
(2)
The Scranton Police Department will forward a letter to all current
vehicle owners who have a handicapped parking sign that states that
they must complete the renewal application and forward same with a
check for $10 to the Scranton Police Department within 90 days. Failure
to forward the renewal application within said time period shall constitute
a forfeiture of the designation, and the City of Scranton Department
of Public Works shall remove any signage from the designated parking
space(s); and
(3)
The Scranton Police Department shall create a renewal application
for handicapped parking signs and issue a copy of same to any vehicle
owner who applies for a handicapped parking sign and receives a sign.

A.
To the fullest extent permitted by law, including, without limitation,
75 Pa.C.S.A. § 6109 and 53 Pa.C.S.A. § 5505, The
Parking Authority of the City of Scranton, Pennsylvania and its designee
shall have and exercise all powers necessary or convenient for the
administration, supervision and enforcement of an efficient system
of on-street parking regulation in the City of Scranton. The powers
shall include, but not be limited to, the following powers and rights:
(1)
To conduct research and maintain data related to on-street parking
activities;
(2)
To issue parking tickets for illegally parked vehicles;
(3)
To collect on behalf of the City of Scranton rates and other charges,
including fines and penalties, for on-street parking violations;
(4)
To boot or tow a vehicle which is illegally parked or the owner of
which is delinquent in payment of the requisite number of previously
issued parking tickets, as set forth in the Code; and
(5)
To own or lease personal property used in connection with the exercise
of any power provided in this paragraph; and

A.
The District Justice of Magisterial Court 45-1-02, after the issuance of a warrant for the arrest of parking violators, is hereby authorized to charge an initial fee of $5 for the preparation and mailing of a boot/arrest notice. Thereafter, if the boot/arrest notice is returned after an unsuccessful attempt to deliver, said District Justice is authorized to charge an additional fee of $5 for identifying the current address of said violator. Thereafter, in the event that the citation remains unpaid, said District Justice is hereby authorized to charge an additional fee of $5 for the coordination of the placement of the boot and/or service of the arrest warrant. Any constable fees and mileage fees which accrue shall be in addition to the fees as authorized above and shall be payable by the violator. The placing of a boot on any vehicle shall remain under the control of the Scranton Police Department or The Parking Authority of the City of Scranton, Pennsylvania and its designee. The penalties, fines and fees described in this § 439-29 shall be in addition to all other penalties, fines, fees and enforcement measures permitted by law.

A.
The Engineer for the City of Scranton has completed
a schematic/map designating parking for certain City personnel after
having received input from the City of Scranton Police Department,
City of Scranton Fire Department, Office of Mayor and Office of City
Council. A copy of the aforesaid schematic/map is attached hereto
and marked as Exhibit A and made part hereof.[1] Said parking designation is authorized and approved.

B.
Any violation of the parking designations/restrictions as indicated in the attached map, which will be further designated by posting of appropriate signage, will subject the owner/operator of the offending vehicle to fines described in § 439-26. In addition, the owner/operator of the offending vehicle will be responsible for any towing and storage costs incurred in the removal of the offending vehicle.

A.
Back-in angled parking is hereby established for the south side of
the 1100, 1300, and 1400 blocks of St. Ann Street. Such parking spaces
shall be at 30° and shall maintain a minimum of 26 feet of the
total curb-to-curb width of the street, to allow for both the parking
spaces and room to maneuver vehicles. Such parking spaces should be
painted on the roadway with signage to delineate those spaces and
to educate the public of the parking requirements. Adequate signage
should be maintained, such as signage explaining how to back into
a back-in angle parking space and signage identifying such parking
spaces as "Back-in Angle Parking Only." Angled parking extents must
be adequate distances from corners as not to obstruct the intersection
and driveway sight distances.

On the north side of said blocks, parallel parking shall be
maintained with a minimum of seven feet of the total curb-to-curb
width of the street. Two travel lanes of opposing directions shall
be maintained with a minimum of 11 feet per lane of the total curb-to-curb
width of the street.

At all times, all state law, state regulations, and PennDOT requirements and specifications shall be adhered to, including but not limited to PennDOT Publication 212 (Official Traffic Control Devices), 67 Pa. Code Chapter 441 and pursuant regulations (Access to and Occupancy of Highways by Driveways and Local Roads), and PennDOT Publication 111 (Pavement Marking and Signing Standards).
