The governing body of the City deems it to be in the interests of the City to provide for the establishment of a residential parking permit program to ensure primary access to available parking spaces by neighborhood residents as well as to provide for a cleaner ambient air level. The powers and duties as contained in this article shall be performed by an Administrator who shall be designated as the Bureau of Police (hereinafter "Administrator") and is enacted for the maintenance of the public health and welfare of the citizens of the City. The Administrator, as provided for above, may be a person, bureau or other legal entity.

A. 
The Administrator is hereby authorized to designate, subject to approval by the governing body as hereinafter provided, the following streets within the City on which the parking of vehicles may be restricted on weekdays, excepting holidays, in whole or part to vehicles having a valid parking permit issued pursuant to this article.

C. 
The authority shall be in addition to and may be exercised in conjunction with any other authority to regulate the times and conditions of motor vehicles parking.
For the purpose of this article, the following terms shall have the following meanings designated for each:
COMMUTER VEHICLE
A motor vehicle parked in a residential area by a person not a resident thereof.
PROPRIETOR
A person who owns or leases real property within a residential area of which he is not a resident, but owns or manages a business enterprise or professional office maintained at that address. For purposes of this article, a proprietor shall be entitled to one parking permit for said business or professional office address.
RESIDENT
A person who owns or leases real property within a residential area and who maintains either a voting residence or a bona fide occupancy, or both, at that address.
RESIDENTIAL AREA
A contiguous area containing public highways or parts thereof primarily abutted by residential properties or residential or nonbusiness property (such as schools, parks, churches, hospitals and nursing homes).
A. 
A residential area shall be deemed impacted and thereby eligible for residential permit parking if:
(1) 
During any period between the hours of 7:00 a.m. and 8:30 p.m. weekdays, except holidays, the number of vehicles parked (or standing) legally or illegally, on the streets in the area equal to 70% or more of the legal on-street parking capacity of the area. For purposes of this criteria, a legal parking space shall be 20 linear feet.
(2) 
During the same period as in Subsection A(1) above, 10% or more of the vehicles parked (or standing) on the streets in the area are not registered in the name of a person residing in this area. For purposes of this criteria, the latest available information from the Department of Motor Vehicles regarding registration of motor vehicles shall be used.
B. 
In determining whether an area identified as impacted and eligible for residential permit parking shall be designated as a residential permit parking area, the Administrator shall take into consideration the following factors:
(1) 
The local and metropolitan needs with respect to clean air and environment.
(2) 
The possibility of a reduction in total vehicle miles driven in the City.
(3) 
The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards.
(4) 
The proximity of public transportation to the residential areas.
(5) 
The desire and need for the residents for residential permit parking and their willingness to bear administrative costs in connection therewith.
(6) 
The need for parking in excess of the residential permit parking program in proximity to establishments located therein and used by the general public for religious, health or educational purposes.
C. 
In order to determine whether a particular street, avenue or other location should be designated as a residential permit parking area, or to determine whether to remove such designation, the Administrator may conduct, upon its own initiative or upon a petition of two-thirds majority of the households in such area, addressed to the Administrator or the Council, a public forum, prior to the designation of a parking permit area, or prior to the withdrawal of such designation once it is established. Such forum shall be held only after due notice has been published in a newspaper of general circulation. The notice shall clearly state the purpose of the forum, the exact location and boundaries of the residential permit parking area under consideration and the reasons why such area is being proposed for the designation or removal as a residential parking permit area. During said forum, any interested person shall be entitled to appear and be heard. No forum shall be held and no area designated if it is not bound to be an impacted area under this section.
D. 
Within 30 days following the close of the public forum, the Administrator shall recommend by report to the Council, based on the record of such forum, whether to designate the area under consideration as a residential permit parking area or to remove the designation in the case of an established residential permit parking area.
E. 
The Administrator's report to Council shall include, inter alia, a recommendation of specific hours and streets as they pertain to the particular needs of each designated residential area.
Following governing body approval of the designation of a residential.permit parking area, the Administrator shall issue appropriate permits and shall cause parking signs to be erected in the area indicating the times, location and conditions under which parking shall be by permit only. A permit shall be issued upon application and payment of the applicable fee, only to the owner or the operator of a motor vehicle who resides on or is a proprietor of property immediately adjacent to a street, avenue or other location within the residential permit parking area. A separate permit shall be required for each motor vehicle.
A. 
The application for a permit shall contain the name of the owner or operator of the motor vehicle, resident's or proprietor's address, the motor vehicle's make, model, license plate number, number of the applicant's operator permit, phone number and e-mail address (where applicable). All residential parking permits must be obtained from the Scranton Police Department at 100 South Washington Avenue, Scranton, PA, 18503, Monday through Friday (excluding holidays) between 8:00 a.m. and 4:00 p.m.

B. 
The motor vehicle's registration and operator's license may, at the discretion of the Administrator, be required to be presented at the time of making said application in order to verify the contents thereof. The permit shall be valid January 1 through December 31 of each respective calendar year. Regular residential parking permits shall only be displayed on the driver's side rear window.

C. 
In the event that a resident who is a valid parking permit holder transfers his or her vehicle, or the vehicle is destroyed and the resident obtains a replacement vehicle, the resident may obtain another permit with the same expiration date as the previous permit without the payment of any additional charge.
D. 
Types of permits.

(1) 
Guest permits. Guest permits provide temporary parking for individuals visiting the permit holder's address. [Note: There are three types of guest permits (temporary special permits, residential guest permit, and contractor permits).] A guest permit may not be used by the registered owner or any car owned or using, nor may it be used by anyone living at the registered address or by anyone in another permit area at another residence.
(a) 
Temporary special permits. Temporary special permits are issued to permit holders to accommodate temporary parking needs such as a planned gathering, holiday visitors, special events, or other special situations. There is no fee for temporary permits, but requests should be made with reasonable advance notice. Guest permits are only valid for a maximum of 48 hours and can be obtained a maximum of four times per year unless a specific special circumstance exists. This temporary permit shall be displayed clearly behind the driver's side front windshield of the vehicle.
(b) 
Residential guest permit.
[1] 
Residential guest permit usage is restricted up to a one-week period at a time and within one block (per vehicle) of the registered address.
[2] 
A guest permit must be hung from the rearview mirror facing out at all times while vehicle is parked in a permit area. Only one residential guest permit can be issued to each residence per calendar year.
[3] 
Guest permits are limited to one per year per residence and are valid from January 1 through December 31 of each respective calendar year. This permit shall cost $5 per year. Fines may not be withdrawn due to improper use or display of guest permits.
(c) 
Contractor permits.
[1] 
Contractor permits can be issued to a contractor doing business with a resident living in a permit parking area for a period not to exceed 30 days and can be reissued for a maximum of three times for the same residence per calendar year. No more than three contractor parking permits will be issued for a single property at any one time. Contractors parking vehicles on any metered street within a parking permit area should, in addition to the contractor parking permit, secure meter hoods from the City's parking meter vendor.
[2] 
A contractor parking permit is a cardboard placard that is displayed clearly behind the driver's side front windshield of the vehicle, used for short term projects in residential permit parking areas within the City of Scranton. Short term projects are defined as parking 30 days or less at the same location. The fee for a thirty-day contractor parking permit is $5 per thirty-day cycle, and the permit is only authorized for the residential block in which the contractor applied for and is currently performing work on. Lost or stolen permits will be reissued at original cost.
E. 
Replacing permits due to new vehicle information (Applies only to active permits).

(1) 
You must return your old permit along with the new car registration. Temporary registrations are acceptable (pink slip).
(a) 
If you scrape off the permit and return it to the Scranton Police Department, your replacement permit will be free.
(b) 
If you do not scrape off your permit, and your license plate number is the same, there is a replacement fee of $5.
(c) 
If you do not scrape off your permit and your license plate number is different, you need a notarized letter stating that you did not scrape off your permit and there is a replacement fee of $5.
(2) 
In all instances you must present your new car registration.
(3) 
Any improper use, including counterfeiting, duplicating, or altering of any type of residential parking permit could result in fines, revocation of all permits, including residential, and the registered owner being charged under the appropriate criminal statutes.
A. 
Notwithstanding any provisions of this article to the contrary, the holder of a residential parking permit shall be permitted to stand or park a motor vehicle operated by him in any designated parking area during such times as the parking of the motor vehicle therein is permitted. While a vehicle for which a residential parking permit has been issued is still parked, said permit shall be displayed so as to be clearly visible on the driver's side rear window of the vehicle. A residential parking permit shall not guarantee or reserve to the holder a parking space within a designated residential permit parking area.

B. 
A residential parking permit shall not authorize the holder thereof to stand or park a motor vehicle in such places or during such times as the stopping, standing or parking of motor vehicle is prohibited or set aside for specified types of vehicles; nor exempt the holder from the observance of any traffic regulations other than residential parking permit restrictions.
C. 
No person other than the permittee names thereon shall use a residential parking permit or display it on their vehicle operated or parked and any such use or display by any person other than the permittee shall constitute a violation of this regulation by the permittee and by the person who so used and displayed such parking permit.
D. 
It shall constitute a violation of this regulation for any person to falsely represent himself as eligible for a residential parking permit or to furnish any false information in an application to the Administrator in order to obtain a residential parking permit.
A. 
The Administrator is authorized to revoke the residential parking permit of any permittee found to be in violation of this article and, upon written notification thereof, the permittee shall surrender to the Administrator. Failure, when so required, to surrender a residential parking permit so revoked shall constitute a violation of this article.
B. 
The Administrator is authorized to establish an annual residential permit parking fee of $5 per registered vehicle, a temporary residential guest permit parking fee of $5 for one vehicle and contractor permits for $5 to cover the administrative costs of permits issued pursuant to this article. Each household will be allowed to obtain three regular residential parking permits and one temporary residential guests parking permit. To obtain these permits, the requestor must provide two current proofs of residence and vehicle registration information. Any permit obtained is only valid for the permit parking area granted near the requestor's residence and cannot be used in any other residential permit parking areas of the City.

C. 
The Administrator is authorized to make provisions for the issuance of temporary parking permits to bona fide visitors of residents of a designated residential parking area upon payment of the fee set forth in Subsection B and for the issuance of exemption parking permits to handicapped persons.
D. 
The Administrator shall adopt rules and regulations necessary for the administration of this residential parking permit program. Said rules and regulations shall be subject to approval by City Council prior to being effective.
A. 
Whoever violates any provision of this article shall, upon conviction thereof, pay to the City of Scranton a fine in the amount of $25 for the first offense, plus costs. For each subsequent offense, the fine shall be $25, plus costs.
B. 
Any duly authorized employee of the City, under the direction of the Mayor, shall notify such person of the unlawful parking charge by placing a written notice or ticket under the windshield wiper or in some conspicuous place on such vehicle, indicating the time of the violation, the amount of the unlawful parking charge and that such charge shall be paid to the City and the place where such charge shall be made and the manner of payment. The unlawful parking charge shall be paid in person at Scranton Police Headquarters, via mail, or online no later than three days after the date of the violation, and the notice of ticket placed on the vehicle at the time of the violation shall advise the owner or operator of such vehicle that, unless the unlawful parking charge is paid within the time limits herein specified, the fine payable under conviction of such unlawful parking and failure to pay such charges will be $5, and costs, and, in default of payment thereof, imprisonment of not more than 10 days.

Eligibility. To be eligible, a parker must reside in a residential unit within the boundaries of the attached map.[1] Proof of residency shall be required.

B. 
Parking is confined to the following garages only: Linden, Casey and Electric City, and only in underutilized areas and designated spaces on the levels above the ground floor and below the uncovered roof of each of these garages.
C. 
The cost of a monthly space is 80% of the regular monthly parking rate. Choosing the Downtown Resident Program does not preclude a parker from being able to switch at any time to the regular monthly parking rate or premium monthly rate programs.
