The purpose of this District is to provide opportunities for limited commercial uses on properties in the Washington Pike Corridor that are transitional between existing commercial and residential areas without significantly impacting adjacent residential properties or the traffic carrying capacity of Washington Pike and to provide for accessory uses and compatible supporting uses as conditional uses or uses by special exception.
In the Washington Pike Overlay, only the following uses are authorized:
A. 
Permitted uses.
(1) 
Principal uses.
(a) 
Forestry, subject to § 240-105.
(b) 
Incidental mineral removal.
(c) 
Single-family dwelling.
(d) 
Essential services.
(e) 
Township-related facilities.
(2) 
Accessory uses.
(a) 
Signs, subject to Article XVIII.
(b) 
Off-street parking and loading, subject to Article XVII.
(c) 
Fences, subject to § 240-99.
(d) 
Other accessory uses customarily incidental to and on the same lot with any permitted use, conditional use or use by special exception authorized in this District.
(e) 
Private residential swimming pools or sports courts, subject to § 240-99.
(f) 
Private garages and storage buildings subject to § 240-99.
(g) 
No-impact home-based business, subject to § 240-106.
(h) 
Keeping of domestic pets.
(i) 
Garage sales and temporary auto sales, subject to § 240-109.
B. 
Conditional uses.
(1) 
Principal uses.
(a) 
Bed-and-breakfast, subject to § 240-95A(4) and (45).
(b) 
Business or professional offices, subject to § 240-95A(45).
(c) 
Churches, subject to § 240-95A(9).
(d) 
Day-care center, subject to § 240-95A(38).
(e) 
Educational studio, subject to § 240-95A(45).
(f) 
Personal services, subject to § 240-95A(45).
(g) 
Specialty retail, subject to § 240-95A(45).
(2) 
Accessory uses.
(a) 
Communications antenna mounted on an existing building or on an existing public utility storage or transmission structure, subject to § 240-95A(12).
(b) 
Temporary construction trailer, model home or sales office, subject to § 240-95A(49).
C. 
Uses by special exception.
(1) 
Principal uses.
(a) 
Temporary use or structure, other than a construction trailer or sales office, subject to § 240-95A(42).
(2) 
Accessory uses.
(a) 
Home occupation, subject to § 240-95A(21).
(b) 
Family day-care home, subject to § 240-95A(17) and (45).
In the Washington Pike Overlay District, all uses shall be subject to the following regulations, except as they may be modified by the express standards and criteria for the specific conditional uses and uses by special exception contained in Article XV.
A. 
Minimum lot area.
(1) 
Single-family dwelling: 10,500 square feet.
(2) 
Conversion of a dwelling to authorized nonresidential use: 10,500 square feet.
(3) 
All other principal uses: one acre.
B. 
Minimum lot width.
(1) 
Single-family dwelling: 75 feet.
(2) 
All other principal structures: 100 feet.
C. 
Maximum impervious surface coverage: 35%.
D. 
Minimum front yard: 35 feet.
E. 
Minimum rear yard.
(1) 
Principal structures: 35 feet.
(2) 
Accessory structures: see § 240-99C.
F. 
Minimum side yard.
(1) 
Single-family dwellings: 10 feet.
(2) 
All other principal structures: 20 feet.
(3)

Maximum height.
(1) 
All principal structures: three stories but no more than 45 feet.
