This chapter, together with the Building Officials and Code Administrators (BOCA) Basic Fire Prevention Code, 1981 Edition, adopted herein, shall be known and may be cited as the "Fire Prevention Code of the Borough of Steelton."
A. 
Basic Fire Prevention Code. There is hereby adopted in its entirety, by the Borough of Steelton, copies of which are on file in the office of the Borough, that certain fire code known as the "BOCA Basic Fire Prevention Code, 1981 Edition," as amended through the effective date of adoption of this chapter, and as published by the Building Officials and Code Administrators International, Inc., save and except portions as are hereinafter deleted, modified, or amended.
B. 
Application. The provision set forth in this chapter and in the BOCA Basic Fire Prevention Code, adopted herein, shall take effect 31 days from the date of enactment of this chapter or any amendment thereto and shall apply throughout the entire Borough.
All the provisions of the Code Enforcement Ordinance of the Borough are hereby adopted with this chapter.[1] The administration and enforcement of this chapter, and of the BOCA Basic Fire Prevention Code herein adopted, shall be carried out by the Chief of the Fire Department with the assistance of the Code Enforcement Officer of the Borough in accordance with the procedures established by the Code Enforcement Ordinance of the Borough and by the BOCA Basic Fire Prevention Code adopted herein. Said Code Enforcement Ordinance provides for certain powers and duties of a Code Enforcement Officer, for the creation of a Code Hearing Board and for procedures relative to applications, fees, permits, inspections, appeals, penalties and other matters.

Deletions. The following sections and subsections of the BOCA Basic Fire Prevention Code, herein adopted, are hereby deleted in their entirety:

Section F-105.5.1, Penalty for violations.
(2) 
Section F-900.2, Permit required.
(3) 
Section F-1300.2, Permit required.
(4) 
Section F-1500.1, Permits and plans.
(5) 
Section F-1600.2, Permit required.
(6) 
Section F-1700.2, Permit required.
B. 
Amendments. The following sections and subsections of the BOCA Basic Fire Prevention Code are hereby amended to read as follows:
(1) 
Section F-100.1, Title, is amended to read as follows:
F-100.1 Title: These regulations shall be known as the "Fire Prevention Code of the Borough of Steelton," hereinafter referred to as the Fire Prevention Code or "this code."
(2) 
Section F-102.1, Enforcement officer, is amended to read as follows:
F-102.1 Enforcement officer: It shall be the duty and responsibility of the Chiefs of the Fire Department under the direction of the Code Enforcement Officer to enforce the provisions of this code herein provided. The designated enforcement officer of this code is herein referred to as the Fire Official.
(3) 
Section F-103.7, Payment of fees, is amended to read as follows:
F-103.7 Payment of fees: A permit shall not be issued until the permit fee prescribed in the Code Enforcement Ordinance has been paid.
(4) 
Section F-104.0, Board of Appeals, is amended to read as follows:
F-104.0 Board of Appeals: Any and all appeals from the determinations of the Fire Official shall be appealed pursuant to provisions of § 2-15C(1) of the Code Enforcement Ordinance, relating to appeals and hearings by the Code Hearing Board.[1]

Section F-105.4, Notice of violation, is amended to read as follows:
F-105.4 Notice of violation: Whenever the Fire Official observes an apparent or actual violation of a provision of this code or other code or ordinance in the Borough, the Fire Official shall prepare a written notice of violation describing the condition deemed unsafe and specifying time limits for the required repairs or improvements to be made to render the building, structure or premises safe and secure. The notice of violations shall be served personally to the responsible owner, occupant, operator or other person in charge or served by certified mail with a return receipt requested or where such responsible person in charge cannot be found, service may be made by posting a notice in or about the structure or premises or by publishing such notice in a newspaper of general circulation for a period of three consecutive days or served by any other method authorized under the laws of the Commonwealth of Pennsylvania.
Any person, firm or corporation who shall violate any provisions of this chapter and/or the Borough's Fire Prevention Code shall, upon conviction in a summary proceeding before any District Justice,[1] be sentenced for each such violation to pay a fine of not less than $10 plus costs and not more than $300 plus costs and, in default thereof, to undergo imprisonment in the county jail for a period not to exceed 30 days. Each day that a violation continues after due notice has been served in accordance with the terms and provisions hereof, shall be deemed a separate offense.

A. 
Savings clause. Nothing in this chapter or in the BOCA Basic Fire Prevention Code, hereby adopted, shall be construed to affect any suit or proceeding now pending in any court or any rights acquired or liability incurred or any cause or causes of action accrued or existing under any act or ordinance repealed hereby. No right or remedy of any character shall be lost, impaired or affected by this chapter.
B. 
Validity. The invalidity of any section or provision of this chapter or the BOCA Basic Fire Prevention Code herein adopted shall not invalidate other sections or provisions thereof.
C. 
Repealer. The Borough of Steelton's Fire Prevention Code, Ordinance No. 71-7 and any ordinance or code provisions conflicting with the provisions hereof are hereby repealed insofar as they are inconsistent with this chapter.
