There is hereby adopted by the Board of Commissioners of the Township of Swatara for the purpose of establishing rules and regulations for the fabrication, erection, construction, reconstruction, enlargement, alteration, addition to, repair, location and use of one- and two-family dwellings, their appurtenances and accessory structures, the CABO One- and Two-Family Dwelling Code, recommended by the Building Officials and Code Administrators International, Inc., being particularly the 1986 Edition, as the One- and Two-Family Dwelling Code of Swatara Township, and each and all of the regulations, provisions, penalties, conditions, and terms of the CABO One- and Two-Family Dwelling Code, 1986 Edition, are hereby referred to, adopted, and made part thereof, as if fully set out in this article, with additions, insertions, deletions, and changes, if any, hereinafter set forth, of which not less than three copies have been and are now filed in the office of the Secretary of the Township of Swatara, Township Municipal Building, 599 Eisenhower Boulevard, Harrisburg, Pennsylvania, and the same are hereby adopted and incorporated as fully as if set forth at length herein and from the date on which this article shall take effect, the provisions thereof shall be controlling in the fabrication, erection, construction, reconstruction, enlargement, alteration, addition to, repair, location and use of one- and two-family dwellings, their appurtenances and accessory structures within the corporate limits of the Township of Swatara.
Nothing in this article or in the One- and Two-Family Dwelling Code hereby adopted shall be construed to affect any suit or proceeding now pending in any court, or any rights acquired, or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby. Nor shall any right or remedy of any character be lost, impaired or affected by this article.
The invalidity of any section or provision of this article or of the One- and Two-Family Dwelling Code hereby adopted shall not invalidate other sections or provisions thereof.
In interpreting and applying the provisions of this code, they shall be held to be the minimum requirements for the promotion of the health, safety and general welfare.

A. 
Section R-106, Violations and Penalties, § R-106.3, is hereby amended to read as follows:
R-106.3 Penalty: Any person, firm or corporation violating any of the provisions of this code shall, upon conviction thereof, be liable to pay a fine of not more than $1,000 and costs of prosecution, and in default of the payment of fine and costs, shall be imprisoned in the Dauphin County Prison for a period not exceeding 30 days, or both. Each and every day or portion thereof during which any violation of any provision of this code is committed or continued shall constitute a separate offense.
B. 
Section R-104, Authority: § R-104 is hereby amended to read as follows:
R-104. Authority: For the purposes of this code, the Building Official shall be the Code Enforcement Officer established in the Code of Ordinances of the Township of Swatara, Chapter 128, Article I. The Code Enforcement Officer shall be responsible for the administration and enforcement of this code as provided for in the Code of Ordinances of the Township of Swatara, Chapter 128, Article I, Administration.

Section R-105 is hereby deleted in its entirety.

Section R-106 is hereby deleted in its entirety.

Section R-107 is hereby deleted in its entirety.

Section R-109 is hereby deleted in its entirety.

Section R-111, § R111.1 is hereby amended to read as follows:
R-111.1 Types of Inspection: Inspection of work performed under the provisions of this code shall be inspected in accordance with the requirements of the Code of Ordinances of Swatara Township, Chapter 128, Article I, Administration.

Section R-111, § R-111.1 through R-111.1.6, are hereby deleted in their entirety.

Section R-113 is hereby deleted in its entirety.

Section R-202, Table No. 2-A, is hereby amended by inserting the following in the columnar table, designation of columns being from left to right in the printed text:

Section R-216, Smoke Detectors, § R-216.1, is hereby amended to read as follows:
R-216.1 Smoke Detectors Required: Smoke detectors shall be installed outside each separate sleeping area in the immediate vicinity of the bedrooms and on each additional story of the dwelling, including basements and cellars but not including crawl spaces and uninhabitable attics. In dwellings or dwelling units with split levels, a smoke detector need be installed only on the upper level, provided the lower level is less than one full story below the upper level, except that if there is a door between levels then a detector is required on each level. All detectors shall be approved and listed and shall be installed in accordance with the manufacturer's instructions.
When alterations, repairs or additions requiring a permit occur, or when one or more sleeping rooms are added or created in existing dwellings, the entire building shall be provided with smoke detectors located as required for new dwellings.

Section R-216, Smoke Detectors, § R-216.2, is hereby deleted in its entirety.
N. 
Section R-411 is hereby deleted in its entirety.
O. 
Section R-412 is hereby deleted in its entirety.
P. 
Chapter 25, §§ P-2501 to P-2510, are hereby deleted in their entirety and the following paragraph is substituted:
P-2501 General: Private or individual sewage disposal systems shall comply with the Pennsylvania Sewage Facilities Act, Act 537, as amended, approved January 24, 1966, and all amendments and supplements thereto, and the rules and regulations promulgated thereunder, Title 25, Pennsylvania Code, Chapters 71, 72, and 73.
Q. 
Part 6, Electrical, is hereby amended to read as follows: "These provisions shall control the design and construction of all new installations of electrical conductors, equipment and systems in one- and two-family dwellings; and all alterations to existing wiring systems therein to insure safety. All such installations shall conform to the provisions of the Electrical Code established in Chapter 128, Article V, Electrical Code, of the Code of the Township of Swatara."
R. 
Part 8, Energy Conservation, is hereby amended to read as follows: "The provisions for energy conservation shall be in accordance with all applicable regulations established by the Commonwealth of Pennsylvania."
