This chapter shall apply to every zoning district within Union Township in accordance with the definition of the zoning districts as found in the Union Township Zoning Ordinance and the official map of Union Township, with the exception of the RC Rural Conservation District.

It shall be unlawful for any person to permit any weeds, grass or plants other than trees, bushes, flowers, agricultural products, ornamental plants, or any other grasses or plants grown in conjunction with farming to grow to a height exceeding 18 inches or to be allowed to be grown without abating and removing the same twice a year by June 1 and by August 15 of each and every year, or whenever the aforesaid weeds, grass or plants exceed 18 inches in height, whichever comes first. Any such plants, grass or weeds exceeding such heights or not abated and/or removed twice a year by June 1 and August 15 are hereby declared to be a nuisance; except if said weeds, grass, or plants are growing in a wooded area, or if located in an AP Agricultural Preservation District, LDR Low Density Residential District, LI Light Industrial District, or an HI Heavy Industrial District, at a distance 75 feet from the property line of any adjoining property owner.

The Board of Supervisors, or any officer or employee of the Township designated thereby for this purpose, is hereby authorized to give notice, by personal service or by United States Mail, to the owner or occupant, as the case may be, of any premises whereon grass, weeds or other vegetation is growing or remaining in violation of the provisions of § 56-2 of this chapter, directing and requiring such occupant to remove, trim or cut such grass, weeds or vegetation so as to conform to the requirements of this chapter, within seven days after issuance of such notice. Whenever, in the judgment of the Board of Supervisors, it shall appear to be impracticable to give notice as above provided, either because the owner or occupant cannot readily be found or because a search for the owner or occupant would entail unreasonable delay, the Board, or any officer or employee of the Township designated thereby for that purpose, may give notice by posting conspicuously on the property where such nuisance exists, a notice or order directing and requiring that such nuisance be abated within seven days. In case any person, firm or corporation shall neglect, fail or refuse to comply with such notice within the period of time stated therein, the Board of Supervisors may order the removal, trimming or cutting of such grass, weeds or vegetation, and the cost thereof, together with a penalty of 10% of the cost thereof, shall be collected by the Township from such person, firm or corporation in the manner provided by law.

Any owner or occupant of any property within Union Township failing to abate the nuisance by removing such weeds, plants or grass, pursuant to § 56-3 of this chapter, shall be and hereby is declared in violation this chapter, and such owner and/or occupant shall, upon conviction thereof, be subject to the penalties set forth in Chapter 1, Article III, General Penalty, of this Code.
