The smoking and/or carrying of a lighted pipe, lighted cigar, lighted cigarette and/or lighted tobacco in any form is prohibited in the areas herein designated.
Except as otherwise provided, smoking shall be prohibited in any and all school buildings located within the Township of Union, County of Berks and Commonwealth of Pennsylvania and in any and all school buses and/or school vans being operated within the said Township of Union. A fire official, appointed by the Board of Supervisors of the said Township of Union, may designate a specific safe location, if requested so to do in writing, in any building, structure or place wherein smoking may be permitted.
A fire official appointed by the Board of Supervisors of the Township of Union, Berks County, Pennsylvania, is empowered and authorized to order the owner or occupant to post "No Smoking" signs in each building, structure, room or place in which smoking shall be prohibited. The content, lettering, size, color and location of required "No Smoking" signs shall be subject to the approval of the fire official. Instead of posting "No Smoking" signs in each building, structure, room or place, the fire official is hereby empowered and authorized to order the owner or occupant to post signs stating "No Smoking in this Building Except Where 'Smoking Permitted' Signs Appear."
It shall be unlawful for any person to obscure, remove, deface, mutilate or destroy a posted "No Smoking" sign.
It shall be unlawful for any person to smoke, throw or deposit any lighted or smoldering substance in any and all school buildings located within the Township of Union, Berks County, Pennsylvania, and in any and all school buses and/or school vans being operated within the said Township of Union where smoking is prohibited.
Where smoking is permitted, there shall be provided on each table, and at other convenient locations, suitable noncombustible ash trays or match receivers.

Any person who violates any provision of this chapter shall be subject to the penalties set forth in Chapter 1, Article III, General Penalty.
