Upper Merion Township hereby adopts the mutual
aid pact with Tredyffrin Township in accordance with the authorization
of the Act of July 12, 1972, P.L. 762, No. 180, § 1 et seq.
The acceptance by Upper Merion Township of the
provisions of the mutual aid pact with Tredyffrin Township shall continue
in effect until terminated by subsequent ordinance of the Board of
Supervisors. The agreement entered into by the Townships involved
shall be binding upon both townships adopting it.
The purpose of the mutual aid pact shall be
to receive and supply police protection, aid and assistance during
emergency situations involving civil disobedience and/or natural disasters.
Each municipality shall pay the cost of its
own personnel while on duty in an emergency covered by this agreement.
The organizational structure necessary to implement
the agreement is as follows:
A. The Chief of Police, or the commanding officer in
his absence, shall have authority to request assistance from other
municipalities in the event of emergency.
B. The Chief of Police of the requesting municipality
shall be the commander and chief of all personnel set to an emergency
situation.
C. Any municipality furnishing standby aid or assistance
may withdraw such aid or assistance at any time.
D. Each municipality shall provide to each other a list
of all police officers employed, including name, rank and designation
of full-time or part-time status. This list shall be corrected as
required.
E. Any police officer of a municipality furnishing aid
shall remain the employee of the municipality originally employed
by him.
F. Any police officer employed by a municipality who
is serving within the territorial limits of the other municipality
shall have all rights, authority and privileges of a police officer
employed by the requesting municipality.
G. It shall not be mandatory that assistance be furnished
to a requesting municipality. The Chief of Police or officer in charge
of the municipality receiving a request shall determine whether or
not such assistance shall be provided.
H. The participating Police Chiefs may establish additional
procedures under which to implement this agreement as shall be necessary
from time to time.
The Township Manager and the Police Chief are
hereby authorized and empowered to execute any and all documents necessary
to carry out the foregoing.
