[Adopted 9-27-1984 by Ord. No. 84-1 as Part 2:300 of the 1984 Warwick Township Code]
Warwick Township, upon the adoption of this article, authorizes and adopts an intergovernmental cooperative agreement pertaining to the purchase and use of materials, supplies, equipment and services with surrounding municipalities who likewise adopt an ordinance similar to this one.
The intergovernmental cooperative agreement referred to in § 7-1 shall:
A. 
Be conditional upon the participating municipality acting in cooperation in the advertisement for bids for the purchase and use of equipment, materials, supplies and services.
B. 
Be for a perpetual term, but any participating municipality may withdraw from the cooperative purchasing agreement by giving all other participating municipalities at least 60 days' prior written notice of its intention to withdraw.
C. 
Be for the purpose and objective of obtaining cost benefits by cooperation in advertising for bids and the cost benefits inherent in the bulk purchasing and use of equipment, materials, supplies and services.
D. 
Provide for each participating municipality to be solely liable for materials and/or supplies purchased by it. The cost of advertising for any particular bid shall be shared equally by those municipalities participating in that particular bid. All other costs properly incurred under the terms of the agreement shall be shared equally by all participating municipalities which are members of the Central Bucks Cooperative Purchasing Council.
E. 
Provide that each municipality that wishes to cooperate shall appoint a representative to serve on a committee known as the "Central Bucks Cooperative Purchasing Council," which Council shall be charged with the responsibility of carrying out the terms of the agreement.
F. 
Provide that all real and/or personal property acquired by reason of the cooperative agreement shall be the sole property for management purposes, disposition, etc., of the individual municipality paying for the same as if the same had been purchased in accordance with the provisions of the Second Class Township Code or the Borough Code[1] without regard to any cooperative agreement.

The Cooperative Purchasing Agreement which is in the possession of the Board or its designee is incorporated herein by reference as if set forth in its entirety and is hereby approved by the Board.
