Warwick Township, Bucks County, Pennsylvania, hereby elects to administrator and enforce the provisions of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. § 4 7210.101 through § 7210.1103, as amended from time to time, and its regulations.
The Uniform Construction Code, contained within Title 34 Pa. Code, Chapters 401 through 405, as amended from time to time, is hereby adopted and incorporated herein by reference as the municipal building code for Warwick Township, Bucks County, Pennsylvania.
Administration and enforcement of the code within Warwick Township shall be undertaken, as determined by the Board of Supervisors for Warwick Township. Bucks County, Pennsylvania, in accordance with the regulations of the Pennsylvania Construction Code Act.
A. 
Creation of Appeals Board. A Building Code Board of Appeals (hereinafter "Appeals Board" is hereby established in conformity with the requirements of the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. § 7210.101 through § 7210.1103; Section 501.(c), and Title 34 Pa. Code, Section 403.121. The Appeals Board shall hear and rule on appeals, requests for variances and requests for extensions of time.
B. 
Appointment of members.The Appeals Board shall consist of five members appointed by the Board of Supervisors as follows: one member shall be appointed to serve a five-year term; one member shall serve a four-year term; one member shall serve a three-year term; one member shall serve a two-year term; and one member shall serve a one-year term. After the initial appointments, each new member shall serve for five years or until a successor has been appointed.
C. 
Qualifications of members. The members of the Appeals Board shall, in the discretion of the Board of Supervisors, be qualified by training and experience to pass on matters pertaining to building construction. Training and experience may consist of licensure as an architect or engineer, experience in the construction industry, or training or experience as an inspector or plan reviewer. No member of the Board of Supervisors or any code inspector employed by the Township may serve on the Appeals Board. If the Board of Supervisors is unable to find a sufficient number of qualified individuals who reside within the Township, it may appoint a qualified person who resides outside of the Township to fill a position.
D. 
Alternate members. The Board of Supervisors shall appoint two alternate members who shall be called by the Appeals Board Chairperson to hear appeals in the event of the absence or disqualification of a member. Alternate members shall possess the qualifications required for Board membership, and shall be appointed for five years or until a successor has been appointed.
E. 
Intergovernmental cooperation. The Board of Supervisors is hereby authorized to enter into an intergovernmental cooperation agreement with one or more municipalities to create an Appeals Board.
F. 
Chairperson and Secretary. The Appeals Board shall annually select one of its members to serve as chairperson and secretary. The Secretary shall file a detailed record of all proceedings in the office of the Township Manager.
G. 
Disqualification of member. A member of the Appeals Board shall not hear an appeal in which that member has any personal, professional or financial interest.
H. 
Operation of Board of Appeals. The procedure for conduct of hearing and notices of hearings shall be established by resolution of the Board of Supervisors and shall be consistent with Pennsylvania law and regulations of the Pennsylvania Department of Labor and Industry.
A. 
All ordinances and/or resolutions or parts thereof which have previously been adopted by Warwick Township on or before July 1, 1999, and which are equal to or exceed the requirements of the code shall remain in full force and effect until such time as the provisions of these ordinances fail to equal or exceed the minimum requirements of the code, as amended from time to time.
B. 
These ordinance provisions, which are hereby saved from repeal include, but are not limited to:
(1) 
Ordinance No. 97-5, adopted on June 16, 1997, establishing requirements for certificates of use and occupancy and codified at Warwick Township Code Chapter 53 and Chapter 61;
(2) 
Ordinance No. 97-6 adopted on June 16, 1997, enacting the 1997 BOCA National Building Code; the CABO One- and Two-Family Dwelling Code, 1997 Edition (Warwick Township Code, Chapter 53); the 1997 BOCA National Plumbing Code (Warwick Township Code Chapter 141); the 1997 BOCA National Fire Prevention Code (Warwick Township Code Chapter 89); the 1997 NFIPA National Electric Code (Warwick Township Code Chapter 69); the 1997 National Mechanical Code (Warwick Township Code Chapter 117); and the 1997 Property Maintenance Code (Warwick Township Code Chapter 57) to the extent the regulations set forth in any of the codes adopted by Ordinance No. 97-6 are stricter than the UCC Building Code;
(3) 
All provisions of Ordinance No. 97-6, as codified and the codes adopted thereunder which equal or exceed the minimum requirements of the code, noting specifically:
(a) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 1 Administration, Section 108.0 Permits, Subsection 108.1 Action on Application. Delete the words "within a reasonable time" and the following: "within 30 days."
(b) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 1 Administration, Section 118.0 Certificate of Occupancy is hereby deleted in its entirety and Ordinance Number 97-5[1] is inserted.

Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 3 Use or Occupancy, Section 310.0 Residential Use Groups, Subsection 310.5 Use Group R-3 structures. Delete the words "fire separation assembly" and insert the following; "masonry fire separation assembly having a minimum thickness of eight inches extending to a minimum of 32 inches above the roof deck."
(d)

Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 3 Use or Occupancy, Section 310.0 Residential Use Groups, Subsection 310.5 Use Group R-3 structures, Exception Number 2. Delete the words "fire partition" and insert the following: "fire separation assembly."
(f) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 3 Use or Occupancy, Section 310.0 Residential Use Groups, Subsection 310.5 Use Group R-3 structures. Insert the following new section: "310.5.2 Dwelling Offsets: Multiple single-family dwellings shall have an offset between adjacent units of not less than two feet. Exceptions: The exterior walls of multiple single-family dwellings shall have a fire resistance rating of one hour for a distance of four feet on either side of the common wall or they shall be provided with a masonry wing wall which extends past the face of the dwelling units, where they share a common wall, for a distance of not less than two feet."
(g) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 3 Use or Occupancy, Section 313.0 Mixed use groups, Subsection 313.1.1 Nonseparated use groups. Delete the words "A fire separation assembly is not required between use groups except as required by other sections of this code." and insert the following: "A fire separation assembly is required between all mixed use groups within structures in addition to any other requirements stated within any other section of this code."
(h) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 4 Special Use or Occupancy, Section 407.0 Private Garages, Subsection 407.4 Attached to rooms: Delete the words "1/2 inch gypsum board" and insert the following; "5/8 inch Type X fire rated gypsum board."
(i) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 5 General Building Limitations, Section 506.0 Area Modifications, Subsection 506.2 Street frontage increase. Add the following: "This increase shall be permitted only when there exists a fire lane having a minimum width of 20 feet which surrounds the entire building or facility."
(j) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 6 Types of Construction, Table 602 Fire Resistance Ratings of Structure Elements. Amend line 4 "Fire Partitions" to provide a minimum of one-hour fire resistance rating for all types of construction.
(k) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 6 Types of Construction, Table 602 Fire resistance Ratings of Structure Elements. Amend line 5 "Dwelling unit and guest room separations" to provide a minimum of two-hour fire resistance rating for all types of construction.
(l) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 7 Fire Resistant Materials and Construction, Section 707.0 Fire walls and Party Walls, Subsection 707.4 Combustible framing is hereby deleted in its entirety and the following shall be inserted: "707.4 Combustible framing: There shall be no combustible framing allowed within any firewall."
(m) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 902.0 Definitions, Subsection 902.1 General. Between "Alarm verification" and "Automatic" insert the following: "Area: All areas identified within this chapter shall be calculated from the outermost edges of the exterior walls."
(n) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 904,0 Fire Suppression Systems, Subsection 904.4 Use Group E. Delete the words "20,000 square feet (1860 m2)" and insert the following: "5,000 square feet (465 m2)."
(o) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 904.0 Fire Suppression Systems, Subsection 904.6 Use Group I. Delete the words "An automatic fire suppression system shall not be required for Use Group I-2 child-care facilities located at the level of exit discharge, which accommodate 100 children or less and in which each child-care room has an exit door directly to the exterior."
(p) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 904.0 Fire Suppression Systems, Subsection 904.8 Use Group R-1. Delete the words "Exception: Where all guestrooms are not more than three stories above the lowest level of exit discharge to the exits serving the guestrooms. Each guestroom shall have at least one door opening directly to an exterior exit access which leads directly to the exits."
(q) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 904.0 Fire Suppression Systems, Subsection 904.9 Use Group R-2. Delete the words: "Exception: Buildings which do not exceed two stories, including basements which are not considered as a story above grade, and with a maximum of 12 dwelling units per fire area. Each dwelling unit shall have at least one door opening to an exterior exit access that leads directly to the exits required to serve that dwelling unit."
(r) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996 Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 904.0 Fire Suppression Systems, Subsection 904.7 Use Groups M, S-1 and F-1. Within Number 1 delete the words "12,000 square feet (1116 m2)" and insert the following: "5,000 square feet (465 m2)."
(s) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 904.0 Fire Suppression Systems. Insert the following new section: "904.7.1 Use Groups S-2 and F-2: Throughout all buildings with a Use Group S-2 or F-2 an automatic fire suppression system shall be provided where the fire area exceeds 5,000 square feet (465 m2)."
(t) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 906.0 Fire Sprinkler System, Subsection 906.5 Sprinkler alarms. Insert the following: "Within all residential use groups that are provided with an approved sprinkler system the system shall include a flow switch, which is hard wired to the approved smoke detection system for the structure, which sounds the smoke detection system when activated."
(u) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 907.0 Limited Area Sprinkler System, Subsection 907.6.3. Delete Exceptions Number 1 and 2 in their entirety.
(v) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 918.0 Fire Alarm Systems, Subsection 918.4.2. Use Group B shall be deleted in its entirety and the following shall be inserted: “918.4.2 Use Group B: A fire alarm system shall be installed and maintained in all occupancies in Use Group B."
(w) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 918.0 Fire Alarm Systems. Insert the following new section; "918.4.7 Use Group F1, F2, S1, S2: A fire alarm system shall be installed and maintained in all occupancies in Use Group F1, F2, S1, S2."
(x) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 919.0 Automatic Fire Detection Systems, Subsection 919.5 Sprinklered Building Exception is hereby deleted in its entirety.
(y) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 920.0 Single and Multiple Station Smoke Detectors, Subsection 920.3 Where Required. Add the following: “In addition to the smoke detectors indicated within this section, a heat detector shall be installed in each garage area located under or attached to all buildings and/or structures within the following Use Groups: R1, R2, R3, R4, I1, 12 and I3. This heat detector shall be hardwired and interconnected to the required smoke detectors."
(z) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 920.0 Single and Multiple Station Smoke Detectors, Subsection 920.3.2 Use Groups R2 and R3, Exception Number 2, shall be deleted in its entirety.

Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 10 Means of Egress, Section 1014.0 Stairways, Subsection 1014.6 Treads and risers. Within Exception Number 8, delete the words "the maximum riser height shall be 7 3/4 inches (197 mm) and the minimum tread depth shall be 10 inches (254 mm)" and insert the following: "the maximum riser height shall be 8 1/4 inches (210 mm) and the minimum tread depth shall be 9 inches (229 mm)."

Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 16 Structural Loads, Section 1606.0 Live Loads, Table 1606. Residential: Attics [Uniform Live Load (psf)] delete "20" and insert "30." Residential: One- and Two-Family Dwelling, Sleeping Rooms [Uniform Live Load (psf)] delete "30" and insert "40."

Delete the words "10 psf" and insert the following: "20 psf."
(ii) 
Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 23 Wood, Section 2303.0 Performance Requirements. Insert the following new section: "2303.1.2 Minimum lumber grade: The minimum lumber grade for any structural member shall be number two as certified by the Western Wood Association."

Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 23 Wood, Section 2307.0 Wood Structural Panels, Subsection 2307.31 Floor and roof sheathing. Add the following: "Notwithstanding anything else within this article, plywood sheathing over supports spaced at 16 inches on center shall not be less than 1/2 inch in thickness."

Ordinance 97-6, adopted June 16, 1997, amended the following portion of the BOCA National Building Coded/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 32 Construction in the Public Right-of-Way, Section 3202.0 Street Encroachments, Subsection 3202.3 Above grade. Add the following: "A person shall not erect, install, remove, rehang or maintain over public property any sign for which a permit is required under the provisions of this code until an approved bond has been filed in the sum of $100,000 as herein required or until an insurance policy has been filed for public liability in the amount of $100,000 per accident and for property damage in the amount of $100,000 as herein required."

Ordinance 99-2, adopted March 1, 1999, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 4 Special Use and Occupancy, Section 407.0. Private Garages, Subsection 407.4 Attached to rooms: Delete the words; "Private garages attached side-by-side to rooms in occupancies in Use Groups R-1, R-2, R-3 or I-1 shall be completely separated from the interior spaces and the attic area by means of 1/2 inch gypsum board" and insert the following: "Private garages in occupancies in Use Groups R-1, R-2, R-3 or I-1 shall have all wall and ceiling surfaces, against both interior and the exterior of the surface, within the garage area provided with 5/8 inch Type X fire-rated gypsum board."

Ordinance 99-2, adopted March 1, 1999, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 9 Fire Protection Systems, Section 904.0 Fire Suppression System. Insert the following new section: "904.12 Use Group R-3 and R-4: An automatic fire suppression system shall be provided throughout all buildings, except detached accessory structures, with an occupancy in Use Groups R-3 and R-4 in accordance with Sections 906.2.1, 906.2.2 or 906.2.3."
(pp) 
Ordinance 99-02, adopted March 1, 1999, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc. Chapter 7, Fire-Resistant Materials and Construction, Section 713.0 Floor/Ceiling and Roof/Ceiling Assemblies. Insert the following new section: "713.6 Preengineered Wood Floor Trusses: All preengineered wood floor trusses (i.e., open-web wood floor trusses) shall be protected by one-half-inch gypsum board, minimum, in all locations within all use groups.

Ordinance 99-2, adopted March 1, 1999, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 14 Exterior Wall Coverings, Section 1405 Veneers, Subsection 14053.6 Building Paper. Delete the words "Where veneers of brick, clay tile, concrete or natural or artificial stone are used" and insert the following: "All exterior wall coverings shall be provided with."
(rr) 
Ordinance 99-2, adopted March 1, 1999, amended the following portion of the BOCA National Building Code/1996, Thirteenth Edition, as published by the Building Officials and Code Administrators International, Inc.: Chapter 21 Masonry, Section 2113.0 Fireplaces and Chimney Flues. Insert the following new section: "2113.5 Preengineered Fireplace Unit: Where a fireplace unit is not provided with a masonry flue (i.e., B-Vent or other approved vent) the living space adjacent to the flue shall be provided with 5/8 inch type X fire-rated gypsum board applied to the chimney side. Where a fireplace unit is placed over a combustible flooring material the fireplace unit and the associated hearth shall be separated from the floor with a minimum 1/2 inch noncombustible layer of material (i.e., tile backer board or other approved material).
C. 
All ordinances and/or resolutions or parts thereof which have previously been adopted by Warwick Township that are in effect as of the effective date of this chapter and whose requirements are less than the minimum requirements of the code are hereby amended to conform with the comparable provisions of the code.
D. 
All other ordinances, resolutions, regulations and policies of Warwick Township not governed by the code shall remain if full force and effect.
This code may be changed and/or modified by the governing body of Warwick Township in accordance with the Pennsylvania Construction Code Act, Act 45 of 1999, 35 P.S. § 7210.101 through § 7210.1103, Section 503.
A fee schedule assessable by Warwick Township for the administration and enforcement undertaken pursuant to this chapter and the code shall be established by the governing body of Warwick Township by resolution from time to time.
In accordance with Section 403.102, (1) of Title 34, Part XIV, Chapter 403, the following regulations set forth in the Pennsylvania Code are amended as set forth below:
A. 
Section 403.43(g). Delete the words "5 years" and replace with the words "three years."
B. 
Section 403.43(h): The permit holder shall keep a copy of the permit on the work site until the completion of the construction or the issuance of a use and occupancy permit, whichever comes later.
C. 
Section 403.62.(c).(1).(xvii) is deleted in its entirety.
D. 
Section 403,64.(d). Delete numbers 1through 4 and replace with the following:
(1) 
Foundation inspection.
(2) 
Wall form inspection.
(3) 
Backfill inspection.
(4) 
Slab inspection.
(5) 
Plumbing, mechanical and electrical system inspection.
(6) 
Frame and masonry inspection.
(7) 
Wallboard inspection.
(8) 
Insulation inspection.
E. 
34 Pa Code 403.82 is hereby amended to read as follows: A building code official shall follow the following procedures if an inspection of an occupied building reveals a violation of the Uniform Construction Code:
(1) 
A construction code official shall discuss the inspection results with the permit holder at the completion of the inspection.
(2) 
The building code official may issue a written notice of violations to the permit holder. The notice is to contain a description of the violations and an order requiring correction of the violations within a reasonable period determined by the building code official. When a violation relates to an unsafe building, structure or equipment, a building code official shall act in accordance with § 403.84 (relating to unsafe building, structure or equipment).
(3) 
After the compliance date contained in the order, the building code official shall inspect the building, structure or equipment to determine whether the violation was corrected. The building code official shall close the order if the violation was corrected. The building code official may issue an order to show cause under § 403.83 (relating to order to show cause/order to vacate) to the owner for a violation that was not corrected.

A. 
In accordance with Section 503.0 of Act 93, Warwick Township may propose and enact an ordinance that exceeds the minimum requirements of Act 45, adopts additional code requirements for alterations associated with residential buildings or adopts stricter code requirements for the regulation of utility and miscellaneous use structures.
B. 
In accordance with this section, Warwick Township shall keep in full force and effect the following requirements in its Building Code, which provisions were in effect as of July 1, 1999, and were previously retained within Ordinance No. 2004-03:
(1) 
All repairs and alterations to residential buildings and all repairs and alterations that increase habitable area, with the exception of certain finished basements as described below, shall comply with the Building Code of Warwick Township adopted on June 7, 2004, and any successor code adopted by the Township pursuant to Act 45 of 1999.

(a) 
R-3 detached single-family dwellings (fully suppressed with a sprinkler system conforming to NFPA 13D), R-2 townhouses, R-2 attached single-family dwellings, that were constructed prior to June 7, 2004, and which meet the following conditions are exempt from the egress requirements for habitable basements set forth in the International Residential Code at Section R310.1, provided that:
[1] 
No sleeping rooms shall be permitted in the basement;
[2] 
No structural changes will be made during the remodeling of the basement area;
[3] 
Interconnected smoke detectors must be provided throughout the dwelling, on each floor and in every bedroom;
[4] 
If a sprinkler system is present, it must be fully operational, and sprinkler head coverage shall meet the NFPA 13D standard for residential sprinkler systems; and
[5] 
A 10 ABC UL-approved fire extinguisher shall be available in the basement area within five feet of the egress stairs.
(2) 
Construction, alteration, enlargement, replacement, repair, removal and demolition of utility and miscellaneous use structures which are greater than 144 square feet in area shall comply with the Warwick Township Building Code adopted on June 7, 2004, and any successor code adopted by the Township pursuant to Act 45 of 1999.
