Washington Township may include, pursuant to Act No. 1996-1,[1] attorney's fees in the costs to collect any delinquent taxes, fees and municipal claims in accordance with the schedule set forth in § 44-3 of this article.

At least 30 days prior to assessing or imposing attorney's fees in connection with the collection of a delinquent account, Washington Township shall, by certified mail, return receipt requested, postage prepaid, mail a notice to the property owner at the owner's last known post office address. If within 30 days of mailing the notice the article of certified mail is refused or unclaimed or the return receipt is not received, then at least 10 days prior to assessing or imposing attorney's fees in connection with the collection of a delinquent account, Washington Township shall send another notice to the property owner at the owner's last known post office address by first-class mail, postage prepaid. The notice to the property owner shall include a statement of Washington Township's intent to impose or assess attorney's fees within 30 days of mailing the notice by certified mail or within 10 days of the mailing of the notice by first-class mail. The notice shall also contain the manner in which the imposition or assessment of attorney's fees may be avoided by payment of the delinquent account.
A. 
The following schedule of attorney's fees shall be applicable to collection of delinquent taxes and fees and municipal claims:
(1) 
Preparation of complaint for District Justice proceeding: $100.
(2) 
Attendance and representation at District Justice proceeding: $300.
(3) 
Filing appeal from District Justice decision: $100.
(4) 
Preparation of municipal claim or complaint for filing in Court of Common Pleas: $100.
(5) 
Filing of municipal lien claim or complaint and service of copies: $50.
(6) 
All proceedings subsequent to filing of a lien or appeal in the Court of Common Pleas: hourly rate of Solicitor's fees to Washington Township, with a minimum charge of $250 for each court appearance.
(7) 
Fee for preparation of documents to satisfy municipal claim or judgment and filing thereof, exclusive of court costs: $25.
B. 
The foregoing schedule of fees may be changed from time to time by resolution of the Board of Supervisors.
