The construction of streets hereafter in the Township of Washington shall be done in conformity with the specifications, regulations and provisions set forth in this article.
As used in this article, the following terms shall have the meanings indicated:
ENGINEER
The Engineer of the Township of Washington appointed by the Township Supervisors.
STREET
As defined in the Subdivision and Land Development Ordinance of the Township of Washington,[1] includes street, avenue, boulevard, road, highway, freeway, parkway, lane, alley, viaduct and any other ways used or intended to be used by vehicular traffic, whether public or private. Included is all the land between the street right-of-way lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, sidewalks, division strips or other areas within the street right-of-way lines. Streets shall be classified as follows:
A. 
ARTERIAL STREET:
(1) 
MAJOR STREETA street serving a large volume of comparatively high-speed and long-distance traffic, including all facilities classified as main and secondary highways by the Pennsylvania Department of Transportation.
B. 
COLLECTOR STREETA street which, in addition to providing access to abutting properties, intercepts minor streets to provide a route serving 50 or more dwelling units or lots to give access to community facilities and/or other collector and major streets. Streets in industrial and commercial subdivisions shall generally be considered collector streets.
C. 
LOCAL ACCESS STREETS:
(1) 
MINOR STREETA street used primarily to provide access to abutting properties.
(2) 
CUL-DE-SAC STREETA minor street intersecting another street at one end and terminating in a vehicular turnaround at the other end.
(3) 
MARGINAL ACCESS STREETA minor street, parallel and adjacent to a major street but separated from it by a reserve strip, which provides access to abutting properties or lots and control of intersections with the major streets.
(4) 
SERVICE STREET (ALLEY)A minor right-of-way providing secondary vehicular access to the side or rear of two or more properties.
(5) 
INTERNAL STREETA minor street used for circulation and access within a development project involving multiresidence or commercial or industrial uses.

All work done pursuant to the provisions of this article shall be inspected by the Engineer.
All streets in the Township shall be constructed in accordance with the specifications hereinafter set forth as follows:
A. 
Compliance with guidelines required.
(1) 
The design of all streets constructed in the Township of Washington shall be in accordance with the guidelines and requirements for design of local roads and streets contained in the Pennsylvania Department of Transportation Design Manual, Part 2, Highway Design, latest revision.
(2) 
All components of the pavement structure and methods of application are to be in accordance with Pennsylvania Department of Transportation Specifications, Form 408.
B. 
A bituminous prime coat, as described in Pennsylvania Department of Transportation Form 408, Section 461, shall be applied after completion of the subgrade.
C. 
When a wearing course is placed adjacent to a curb, it shall be sealed as prescribed in Section 401.3(G) of Pennsylvania Department of Transportation Form 408.
D. 
In the application of tar, asphalt or other liquid materials, care shall be taken so that the same will not be applied excessively or carelessly to the curbs, and, in the event of the same, it shall be removed by the applying party.
E. 
Concrete curb or driveways chipped, broken or damaged during roadway construction shall be properly repaired by the person or persons responsible for the same.
The Township will accept into its road system only those streets within or adjacent to subdivisions which have been constructed in accordance with specifications and requirements of this article and the Subdivision and Land Development Ordinance of the Township.[1] Proof of compliance with the specifications and requirements of § 101-4 of this article shall be provided by written request of the Engineer to inspect and/or observe the work during construction and installation of the same or by providing boring data as required by the Engineer and in accordance with the requirements for testing the appropriate materials and method of application detailed in Pennsylvania Department of Transportation Form 408, latest revision. The costs of such inspection or tests, including engineering fees, shall be borne by the developer and/or owner.

The Township may accept into its road system any street constructed in accordance with this article and the Subdivision and Land Development Ordinance of Washington Township[1] upon receipt of a fully executed deed therefor and the proposed resolution in proper form for adoption, recording and filing with the court, with all costs of processing the same to be provided by the grantor.

The cost and expense of any type of construction mentioned hereinbefore shall be paid for by the developer or the owners of the real estate abutting on the street or highway or part thereof whereon such improvement is made. Should the Township make the construction, the cost and expense thereof shall be collected from the developer or the owners of the real estate abutting on such street or highway, or part thereof, in proportion to the frontage or by an equal assessment on the front feet. Such proportionate cost and expense or assessment shall be computed by the Engineer. The Supervisors shall collect said cost and expense or assessment in the manner provided by law.
Should the forms, specifications and/or regulations of the Commonwealth of Pennsylvania, which are incorporated by reference in this article, be subsequently amended, replaced or in any other way changed, this article shall be automatically amended to incorporate herein the subsequent, similar forms, specifications and/or regulations of the Commonwealth of Pennsylvania. It is the intent of this article to achieve a strong degree of uniformity therewith.

Any person who shall violate or fail to comply with any of the provisions of this article shall be subject to a civil fine not exceeding $600. The Township Roadmaster, or any other Township representative authorized by the Board of Supervisors, shall determine in each instance whether a violation of this article has occurred and, if so, the amount of the civil fine to be imposed upon the violator. Notice of the civil fine shall be served upon the violator by certified mail, return receipt requested, or by personal delivery by a Township representative. Should the violator not pay the civil fine within 20 days of the date of service, the Township Roadmaster or other duly designated Township representative shall file a civil enforcement proceeding with the District Justice having jurisdiction to recover the civil fine, court costs and reasonable attorney fees incurred by the Township as a result of the violation. No judgment shall be imposed until the date of the determination of a violation by the District Justice. If the violator neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable Rules of Civil Procedure. Each day that a violation continues shall constitute a separate offense.
