A.
Short title. This chapter shall be known and may be
cited as the "Washington Township Subdivision and Land Development
Ordinance of 1989."
B.
Purpose. The purpose of this chapter is to:
(1)
Assure sites suitable for building purposes and human
habitation.
(2)
Provide for the harmonious development of the Township.
(3)
Provide for the coordination of existing streets with
proposed streets, parks or other features of the Township's Comprehensive
Plan.
(4)
Provide for adequate open spaces, for traffic control,
recreation, light and air, for proper distribution of population and
protection of conservation areas.
(5)
Create conditions favorable to the health, safety
and welfare of the citizens of the Township.
(6)
Provide for an interconnected system of high-quality
open space design where development occurs.
A.
The provisions of this chapter shall be held to be
the minimum requirements to meet the above-stated purposes. Where
the provisions of this chapter impose greater restrictions than those
of any statute, other ordinance or regulation, the provisions of this
chapter shall prevail. Where the provisions of any statute, other
ordinance or regulation impose greater restrictions than those of
this chapter, the provisions of such statute, ordinance or regulation
shall prevail.
B.
Should any article, section, provision or clause of
this chapter be declared by a court of competent jurisdiction to be
unconstitutional or invalid, such decision shall not affect the validity
of the chapter as a whole or any part thereof other than the part
so decided to be unconstitutional or invalid.
The subdivision and land development regulations
adopted hereunder to carry out the intent and purpose of this chapter
shall include definitions; design standards for streets, alleys, sidewalks,
blocks, lots, recreational areas and community assets, greenways,
trails, open space, monuments, storm drains, culverts, sanitary sewers
and other improvement construction requirements; plan requirements
and processing procedures for the sketch plan, preliminary plan (including
a minor plan) and final plan, including record plan and improvement
construction plan; and conditions of acceptance by the Township and
Authority of sanitary sewers, streets and other improvements.
A.
No subdivision of any lot, tract or parcel of land
shall be approved and no street, alley, sanitary sewer, storm drain,
water main, gas, oil and electric transmission line or other facilities
in connection therewith shall be laid out, constructed, opened or
dedicated for public use, traveled upon or used for the common use
of occupants of buildings abutting thereon except in accordance with
the subdivision and land development regulations adopted hereunder.
B.
No lot in a subdivision may be sold and no permit
to erect, alter or repair any building upon land in a subdivision
shall be issued unless and until:
(1)
A subdivision and/or and development plan has been
approved and recorded; and
(2)
The required improvements in connection therewith from the lot or building to an existing improved street have either been constructed or the subdivider/developer has posted financial security with the Township and Authority, as required in § 107-49 of this chapter, to ensure that the public improvements will be installed.
