A Fire Department is hereby created in the Borough of Waynesboro,
Pennsylvania.
The purpose of the Fire Department and the duties of the members
shall be to protect lives and property, to make speedy rescue of persons
and convey them to a place of safety, to extinguish fire and prevent
its spreading to adjacent property; in case of collapsed buildings,
to rescue all persons or bodies, to clear away debris, and to remove
all weak or dangerous parts of buildings.
The personnel of the Fire Department shall consist of the following
officers and members:
The Fire Department shall be equipped with such firefighting
apparatus as the Borough Council shall authorize.
A paging alert shall be used for fires and other emergencies
in the Waynesboro Fire District.
A.
All applicants for Fire Chief shall meet the minimum qualifications
as may be adopted by the Borough Council from time to time.
B.
The Fire Chief shall reside within a radius of 15 air miles of the
geographical center of the Center Square of Waynesboro, Pennsylvania,
as depicted on the map attached hereto and incorporated herein as
Exhibit A.[1]

C.
The Fire Chief shall be required to undergo a physical examination
in accordance with the physical examination policy adopted by the
Borough on May 2, 1984, or as policy may be amended from time to time.
A.
All applicants for the positions of Deputy Chief and Assistant Chief
shall meet the minimum qualifications as may be adopted by the Borough
Council from time to time.
B.
The Deputy Chief and Assistant Chief shall reside within a radius
of 15 air miles of the geographical center of the Center Square of
Waynesboro, Pennsylvania as depicted in Exhibit A.[1]

D.
Council will take recommendations for these positions into consideration
from the Waynesboro Volunteer Fire Department; however, the final
decision shall be the Borough Council's. Applications and recommendations
must be in the hands of the Borough Secretary by December 15 of odd-numbered
years.
The paid apparatus drivers of the Fire Department shall be appointed
by the Borough Council in accordance with the civil service provisions
of the Borough Code.[1]

The two Captains and two Lieutenants shall be elected by the
Waynesboro Volunteer Fire Department. Such election shall be held
in the manner prescribed by the constitution and bylaws of the Waynesboro
Volunteer Fire Department.
A.
The relief apparatus drivers shall meet the minimum requirements
as may be set from time to time by the Borough Council of Waynesboro.
B.
The relief apparatus drivers shall be members of the Waynesboro Volunteer
Fire Department.
C.
The relief apparatus drivers shall be appointed by the Borough Council
of the Borough of Waynesboro with the written recommendation of the
Fire Chief.
The salaries of the Fire Chief, Deputy Chief, Assistant Fire
Chief and apparatus drivers shall be fixed by the Borough Council.
A.
The Fire Chief shall have full charge and control of all apparatus
and firefighting equipment, and give general directions as to how,
when and where such apparatus and equipment shall be used. The Fire
Chief shall have full charge of all paid employees of the Department
at all times and have supreme command on emergency calls.
B.
The Fire Chief shall function under the general direction of the
Borough Manager and the Property Committee of the Borough Council.
The Fire Chief shall perform his/her duties in accordance with established
policies and objectives of the Fire Department as may be set from
time to time.
C.
The Fire Chief, along with the Deputy Chief and Assistant Chief,
will establish a set of operating guidelines, which shall be approved
by the Borough Council. These guidelines will be reviewed from time
to time, and all changes shall be approved by the Borough Council.
D.
The Fire Chief, Deputy Chief, Assistant Chief and apparatus drivers
shall attend such seminars and courses as may be required by Borough
Council from time to time.
E.
The Fire Chief shall maintain liaison with other local fire departments
and the Franklin County Department of Emergency Services.
F.
The Fire Chief shall supervise fire apparatus drivers, the Deputy
Chief, the Assistant Chief, the Captains, the Lieutenants, volunteer
firefighters and mutual aid companies, and shall be responsible for
the written evaluation of the apparatus drivers annually.
G.
The Fire Chief shall prepare and maintain personnel records, reports
and direct training of the Fire Department personnel.
H.
The Fire Chief shall be responsible for the maintenance of all Department
equipment and Borough firehouses.
I.
The Fire Chief shall be required to attend administrative staff meetings,
Property Committee meetings and the second monthly meeting of the
Borough Council.
J.
The Fire Chief shall be responsible for upholding the highest possible
moral standards in and about the firehouses and the scene of emergencies
at all times.
K.
The Fire Chief shall make, or cause to be made, periodic inspections
of buildings in the business section and other appropriate buildings
of the Borough of Waynesboro for fire hazards, and shall submit reports
of such inspections with the monthly report to Council.
L.
The Fire Chief shall submit all monthly reports such as fire reports,
equipment reports and inspection reports, to the Borough Council in
time for their second monthly meeting.
M.
The Fire Chief shall, in addition to the foregoing, discharge all
duties imposed upon him/her by other ordinances and policies of the
Borough of Waynesboro as may be set from time to time. The Fire Chief's
performance shall be reviewed through the monthly reports to Borough
Council. The Fire Chief's administration and performance shall
be evaluated by the Borough Manager and the Property Committee annually.
A.
The Deputy Chief (or in his/her absence, the Assistant Chief) shall
be next in command at all emergency scenes, and their orders shall
be obeyed by all firefighters.
B.
In the absence of the Chief, for any cause, the Deputy Chief or Assistant
Chief who has been so designated by the Fire Chief, shall be Acting
Chief, and shall have the same authority as that vested in the Fire
Chief when they serve as Acting Chief.
A.
The apparatus drivers shall receive their orders from the Fire Chief,
or in his/her absence, the Deputy Chief or Assistant Chief.
B.
The apparatus drivers must keep their apparatus clean and have it
present a neat appearance at all times; and they are custodians of
the firehouse.
C.
The apparatus drivers shall perform other duties as may be assigned
them by the Fire Chief from time to time.
A.
Only members of the Waynesboro Volunteer Fire Department shall be
permitted to ride on the apparatus while responding to or returning
from a fire or fire alarm. All other persons must be kept off the
apparatus at all times; and it shall be the duty of the drivers, officers
and members of the Waynesboro Volunteer Fire Department to enforce
these rules.
B.
From time to time, standby crews are used and they may ride the apparatus
with permission being granted by the Fire Chief, Deputy Chief or Assistant
Chief.
A.
The Waynesboro Volunteer Fire Department shall select up to 20 of
its members who may be appointed Fire Police, and their names shall
be in the hands of the Borough Manager by December 15 of odd-numbered
years. After they are appointed by the Borough Council, they shall
be duly sworn in by the Mayor to perform all the duties of their office
with fidelity.
B.
The duty of the Fire Police shall be to respond to all emergencies,
secure property and prevent all unauthorized persons from interfering
at emergencies. They are to serve in that capacity, working in conjunction
with the Police Department and the Fire Chief.
A.
The Waynesboro Firemen's Relief Association is hereby recognized
as the proper and official organization for the relief of volunteer
firefighters in the Borough of Waynesboro, Pennsylvania.
B.
The treasurer of the Borough of Waynesboro, Pennsylvania, is hereby
authorized and directed to pay to the treasurer of the Waynesboro
Firemen's Relief Association all monies which may be received
from the state treasurer out of the funds created by the 2% tax upon
foreign fire insurance premiums, as provided in the Act of 1895, P.L.
408, Section 2, as amended, 72 P.S. § 2262.[1]
