[HISTORY: Adopted by the Borough Council of the Borough of Waynesboro 8-16-1978 by Ord. No. 832 (Ch. XXVI of the 1970 Code). Amendments noted where applicable.]
This chapter is enacted for the protection of the health, safety, welfare and convenience of the people using the public streets and alleys of the Borough of Waynesboro, Pennsylvania.
No owner of any lot, place or area within the Borough of Waynesboro, Pennsylvania shall permit any bush, shrub or tree which is growing upon their land to extend into or over any public street or alley in such manner that the same interferes with free passage of the vehicular traffic on any street or alley or pedestrian traffic on any sidewalk area, and no owner shall permit any dead or decaying limbs which overhang any public street, sidewalk or alley to remain in any tree.
It shall be the duty of every police officer of the Borough of Waynesboro to report any violation of this chapter which may come to his attention to the Chief of Police of the Borough of Waynesboro, Pennsylvania.
Upon the failure and neglect or refusal of any owner of any lot, place or area within the Borough of Waynesboro to remove any growth of bush, shrub or tree which protrudes into or over a public street or alley and which interferes with vehicular or pedestrian traffic within 20 days after the same has created interference with said traffic, or dead limbs which overhang any public street, sidewalk or alley within 60 days after the same are observed to be dead or decaying, the Chief of Police shall notify the Borough Manager who is hereby authorized and empowered to pay for the removal of such protruding growth or decaying limbs or to order the removal of the same by the Borough Maintenance Department.
When the Borough has caused the removal as aforesaid or has paid for its removal, the actual cost thereof plus 10% shall be charged to the owners of said lot, place or area and shall be due and payable to the Borough within 30 days from the date of invoice.
Upon failure to pay for said removal as above set forth, the claim for said actual cost plus 10% may be recovered by proper action in assumpsit in the name of the Borough and shall further be chargeable against the property as a special assessment.
Any person, firm, partnership, association or corporation violating any section or sections of this chapter shall upon summary conviction before Magisterial District Judge be sentenced to pay a fine of $25 and costs of prosecution for the second and subsequent offenses thereof.
