GENERAL REFERENCES

The office of Township Manager is hereby created by the Township of West Whiteland.

The Manager shall be appointed for an indefinite term by a majority of all of the members of the Board. The Manager shall serve at the pleasure of the Board and may be removed at any time by a majority vote of all its members.
The Manager shall be chosen solely on the basis of executive and administrative abilities as well as personal qualities with special reference to the duties of the office as herein outlined. The Manager need not be a resident of the Township.

Before entering upon the duties of the position, the Manager shall give a bond to the Township with a bonding company, as surety, to be approved by the Board, conditioned upon the faithful performance of the duties, the premium for said bond to be paid by the Township.

The salary of the Township Manager shall be fixed at the time of employment and may be adjusted from time to time by a majority vote of the Board.

A. 
The Manager shall be the Administrative Officer of the Township and shall be responsible to the Board as a whole for the proper, efficient and economical administration of the affairs of the Township. The Manager shall act at all times with complete fidelity and in a way that will reflect credit upon, and benefit to, the Township and its government as a whole. The powers and duties of administration of Township business, as outlined in this Part I, Administrative Legislation, of the Code of the Township of West Whiteland, and amendments or directives related thereto, shall be vested in the Manager, unless expressly imposed or conferred by statute upon other Township officers.
B. 
Subject to recall by ordinance of the Board, the powers and duties of the Township Manager shall be to:
(1) 
Supervise and be responsible for the activities of all municipal departments, except the Police Department. The Manager shall assist the Chief of Police or ranking officer in the administration of the Department but shall not exercise operational control or supervision over its activities of uniformed police officers of the Police Department;

(2) 
Prescribing personnel policies and regulations for personnel, subject to prior notification to the Board, and shall administer and enforce those personnel policies and regulations;
(3) 
Hiring, suspending or discharging of any employee with the terms of any hiring subject to the concurrence of the Board, except that the suspension or removal of a uniformed police officer, including members of the command staff, shall comply with all applicable provisions of the Second-Class Township Code;
(4) 
With the concurrence of the Board, fixing wages and salaries of all personnel not subject to a collective bargaining agreement;
(5) 
Preparing and submitting to the Board not less than 45 days before the close of each fiscal year, a budget for the next fiscal year and an explanatory budget message, and administering the budget after its adoption by the Board;
(6) 
In conjunction with the preparation of the yearly budget, develop long-range fiscal plans for the municipality, such plans to be presented annually to the Board for its review and adoption;
(7) 
Hold such other municipal offices and head such municipal departments as the Board may from time to time direct;
(8) 
Attend all meetings of the Board and its commissions with the right to take part in the discussions, and receive notice of all special meetings of the Board and its commissions;
(9) 
Prepare the agenda for each meeting of the Board and supply facts pertinent thereto;
(10) 
Keep the Board informed as to the conduct of Township affairs; submit periodic report on the condition of the Township finances, and such other reports as the Board requests; and make recommendations to the Board as the Manager deems advisable;
(11) 
Submit to the Board, as soon as possible after the close of the fiscal year, a complete report on the finances and the administrative activities of the Township for preceding year;
(12) 
See that the provisions of all ordinances, franchises, leases, permits and privileges granted by the Township are observed;
(13) 
Employ, subject to approval of the Board, experts and consultants, to perform work, and to advise in connection with any of the functions of the Township;
(14) 
Ensuring proper procedures and controls are in place for:
(a) 
The letting of contracts in due form of law, and the performance and faithful execution of the same, except insofar as such duties are expressly imposed by statute upon some other Township officer;
(b) 
The collection of all money owed to the Township in a timely manner, and the proper proceedings are taken for the security and collection of all the Township' s claims; and
(c) 
The purchase, in accordance with the provisions of the Second-Class Township Code, of all supplies and equipment for the departments and for such other offices, agencies and commissions as the Board may from time to time direct;
(15) 
Investigating and responding to, or designating the same to the appropriate employee, complaints regarding Township services and report those of significance to the Board;
(16) 
Analyzing thoroughly all matters requiring Board decision, representing fairly and objectively all facts pertinent to these decisions;
(17) 
Maintaining a high level of public relations for all elements of the Township government, including periodic reports and such other information as the Manager may be directed to prepare from time to time by the Board;
(18) 
Taking action on authorizing and/or denying interim financial security release requests pursuant to the requirements under the Township' s Subdivision and Land Development Ordinance[1]; and

(19) 
Taking action on denying or partially denying any final financial security release requests when the Township Engineer has not certified a full release of the request, pursuant to the requirements under the Township's Subdivision and Land Development Ordinance.

If the Manager becomes ill or needs to be absent from the Township, he or she shall designate one qualified member of the staff to perform the duties of the Manager during the absence or disability. The person so designated shall not perform these duties for a period longer than two weeks without the approval of the Board.
