This article shall be known as the "West Whiteland Township
Fire Prevention Code."

Except as amended and modified by the Pennsylvania Uniform Construction Code contained in 34 Pennsylvania Code Chapters 401 through 405, the International Fire Code, as published by the International Code Council, Inc., is hereby adopted as the Fire Prevention Code of West Whiteland Township for the control of buildings and structures as herein provided, with the additions, insertions, deletions and changes, if any, prescribed in § 129-28 of this article.
The ICC International Fire Code is amended and changed in the
following respects:
A.
Section 101.1, insert "West Whiteland Township," second line.
B.
Delete Sections 103.2 and 103.3 and insert the following:

103.2 Appointment: The Fire Marshal and Assistant
Fire Marshals shall be appointed by the Board of Supervisors of West
Whiteland Township and shall serve at the Board's pleasure. References
herein to the "fire code official" shall mean the Township Fire Marshal
or Assistant Fire Marshal(s).

D.
Add a new Section 104.1.2 to read as follows:

104.1.2 Fire Lane Enforcement: Fire lane or other
traffic regulations shall be enforced by the fire code official or
his duly authorized representative or any Township police officer.

H.
Delete Section 109.3 and insert the following:

109.3 Penalty for Violation: Any person who shall
violate a provision of this code or who shall fail to comply with
any order of the fire code official issued pursuant hereto or who
shall use, erect, construct, alter or repair a building or structure
in violation of an approved plan or of a directive of the fire code
official or of a permit or certificate issued under the provisions
of this code shall be liable, upon summary conviction, to fines and
penalties of a minimum of $100 and not more than $1,000 and/or imprisonment
of not more than 30 days, as provided in the appropriate court for
each offense. Each day that a violation continues after service of
notice as provided for in this code shall be deemed a separate offense.

I.
Add new Sections 114.0, 114.1, 114.2, and 114.3 to read as follows:

114.0 Fire Control: Fire control measures and regulations
governing conditions which could impede or interfere with fire-suppression
forces.

114.1 Blocking Fire Hydrants and Fire Department Connections: It shall be unlawful to obscure from view, damage, deface, obstruct
or restrict the access to any fire hydrant or any Fire Department
connection for the pressurization of fire-suppression systems, including
fire hydrants and Fire Department connections located on public or
private streets, access lanes, or private lanes.

114.2 Hydrant Use Approval: A person shall not
use or operate any fire hydrant intended for the use of the Fire Department
for fire-suppression purposes unless such person first secures a written
permission and/or permit from the water company supplying the hydrant.

114.3 Interference with Fire Department Operations: It shall be unlawful to interfere with, attempt to interfere with,
conspire to interfere with, obstruct or restrict the mobility of or
block the path of travel of any Fire Department emergency vehicle
in any way or to interfere with, attempt to interfere with, obstruct
or hamper any Fire Department operation.

Add new Section 1011.4.1 to read as follows:

1011.4.1 Additional Locations/Low-Level Exit Signs: In all A-1, A-2, A-3, B, E, R-1, R-2, I-1, I-2, and H occupancies
that are required to have more than one exit or exit access, the requirements
of Section 1011.4 shall be supplemented by additional low-level internally
illuminated or self-illuminated or self-luminous exit signs reading
"EXIT." Additional exit signs shall be located on the latch side of
the door frame wall within six inches to eight inches of the floor,
in addition to the one above or egress access areas. Self-illuminated
or luminous exit signs shall be UL-listed for this purpose and approved
by the Fire Marshal/Code Administration Officer.

Delete Sections 1011.5, 1011.5.1, 1011.5.2, and 1011.5.3 completely.
Ordinance No. 317, dated May 25, 2004, as amended, of West Whiteland
Township is hereby repealed.
Nothing in this article or the Fire Prevention Code hereby adopted shall be construed to affect any lawsuit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 129-29 of this article, nor shall any pending suit or legal right or remedy of any character be lost, impaired, or affected by this article.
The granting of any permit or registration certificate, the
performance of any review or inspection, or any other action taken
under this article by the Township or any of its designated officials
shall not constitute a representation, guaranty, or warranty of any
kind by the Township or any of its officials or employees as to the
quality, workmanship or effectiveness of any construction or repairs
and shall create no liability upon or a cause of action against the
Township, its officials or employees for any property damage or personal
injury that may result from any such construction or repairs.
