[Adopted 9-17-1990 by Ord. No. 175 (Ch. 15, Part 7, of the 1983 Code of Ordinances)]
The Board of Supervisors may, upon application, within its discretion, permit the owner of real property which borders on the right-of-way of a Township road to install a basketball backboard and post within the right-of-way of the road adjoining his property under the following conditions:
A. 
The post may only be installed within the right-of-way of a cul-de-sac, as the term is defined within Chapter 281, Subdivision and Land Development, of the Code of the Township of West Whiteland.
B. 
The sight distance on the right-of-way and from all driveways leading into the right-of-way will not be affected due to placement of the post.
C. 
The placement of the post will not interfere with snowplow operations.
D. 
A petition be signed by all property owners living within 300 feet of the proposed location of the post indicating they do not object to the installation of the backboard and post.
E. 
The applicant signs an agreement, in form and substance acceptable to the Township Solicitor, indemnifying the Township for any actions brought against the Township for personal injury or property damage relating to the installation of the backboard and post.
