The Township of Whitemarsh, pursuant to an intermunicipal agreement entered into with the Township of Springfield, discharges certain of its wastewater through Springfield Township to the Philadelphia Wastewater Collection and Treatment System, for which the City of Philadelphia is primarily responsible. This article provides for the establishment, by resolution, of regulations and uniform requirements for direct and indirect contributions of wastewater within the jurisdiction of Whitemarsh and which is ultimately discharged to the Philadelphia Wastewater Collection and Treatment System. Whitemarsh is responsible for enforcement of this article in the first instance, but the City of Philadelphia and Whitemarsh Township share the duty to enforce this article to the extent necessary to assure the City of Philadelphia's compliance with the Federal Water Pollution Control Act, as amended by the Federal Water Pollution Control Act Amendments of 1972, the Clean Water Act of 1977 and the Water Quality Act of 1987, 33 U.S.C. 1251 et seq., and any subsequent amendments thereto, and the general pretreatment regulations (40 CFR Part 403), along with all applicable state and federal laws and permits. The City of Philadelphia shall not have any jurisdiction or authority to enforce this or any article as they might relate to contributors whose discharge does not enter the Philadelphia Wastewater Collection and Treatment System.
Regulations shall be adopted by resolutions approved by the Board of Supervisors, providing for the regulation of direct and indirect contributors to the Philadelphia Wastewater Collection and Treatment System through the issuance of permits to certain nondomestic users and through enforcement of general requirements for other users; authorizing the monitoring and enforcement activities; requiring user reports; assuming that the existing customers' capacity will not be preempted; and providing for the setting of fees for the equitable distribution of cost resulting from the program established herein.
This article and the regulations adopted pursuant thereto shall apply to the Township and to persons outside the Township who are users of the Township wastewater collection system that ultimately flows into the Philadelphia Wastewater Collection and Treatment System. This article and the regulations adopted hereunder shall apply to only that part of the Township that is served by and flows into the Philadelphia Wastewater Collection and Treatment System.
A. 
Except as otherwise provided herein, the Manager of the Township shall administer, implement and enforce the provisions of this article. This article shall be implemented with the adoption of detailed regulations at the time of the adoption of this article.
B. 
The judicial enforcement remedies shall be as stated in Section 6, Civil Penalties Assessment Policy, of the regulations adopted by resolution pursuant to this article.
