A. 
Any sidewalk or curb installed in the Township, either voluntarily by the property owner or because required by the Township, shall be kept in a proper state of repair. If any sidewalk or curb or portion thereof, by virtue of its condition, shall constitute a danger to public health and safety, the sidewalk or curb or portion thereof shall be repaired by the property owner in accordance with Township specifications within 30 days of receipt of written notice from the Township. No sidewalk or curb shall be removed without the prior approval of the Board of Supervisors.
B. 
Should a property owner fail to repair or replace sidewalks or curbs within the thirty-day period after notice from the Township, the Township may, at its discretion, proceed to perform such work upon the adoption of a resolution by the Board of Supervisors.
C. 
A written notice of the meeting in which it is proposed to adopt the resolution, along with a copy of the resolution, shall be given by certified mail to each property owner at the address to which Township real estate tax notices are sent and by delivery of a copy of such notice by the Township to the affected premises. Such sending and delivery of notice shall be accomplished at least 10 days before the time set for proposed adoption of such resolution. Any adjourned meeting for consideration of such resolution shall be held without further notice if the time and place thereof is announced at the first such meeting. The notice shall include the time and place of the meeting of the Board of Supervisors at which the proposed resolution could be adopted and that the property owner may appear to express his/her opinion regarding adoption of the resolution.
D. 
Repairs of sidewalks and curbs required under the provisions of this section shall be done at the expense of the property owner. The Township shall assess the property owner for the cost of the work that it performs and seek reimbursement by any lawful means.
A resolution authorizing curb and sidewalk work under § 103-37 shall contain the following: the property affected; the work to be done in accordance with the resolution; notice that the Township may, without further notice, do and complete such work and charge the property owner for it in accordance with such resolution; and that the property owner may appear at the time and place set forth in such notice to express his/her opinion regarding adoption of such resolution.
Any person or persons, corporation, partnership or other entity whatsoever violating any of the provisions of this article shall, upon conviction, be sentenced to pay a fine not to exceed the maximum fine of $1,000 and the cost of prosecution and, in default of payment of such fine, imprisonment for a term not exceeding 30 days; provided, however, that if the District Justice determines that a defendant is without the financial means to pay the fines and costs immediately or in a single remittance, such defendant shall be permitted to pay the fines or costs in installments and over such period of time as the District Justice deems to be just.
