The Office of Township Manager is hereby created by and for the Township of Willistown.

One person shall be appointed by a majority vote of the members of the Board of Supervisors to fill the office of Township Manager. That person shall be known as the "Township Manager" (hereinafter sometimes referred to as the "Manager"). The Township Manager shall be appointed to an indefinite term, shall serve until his or her successor is appointed and qualified, shall serve at the pleasure of the Board and shall be subject to removal by the supervisors by majority vote. At least 60 days before such removal is to become effective, the Board shall furnish the Manager with a written statement setting forth its intention to remove him or her; provided, however, that in any situation deemed by the Board in its sole discretion to be an emergency, the removal of the Township Manager may be made effective immediately upon the action of the Board, in which case a written statement of the Board notifying the Township Manager of its action shall be supplied to him or her as soon as practical thereafter. The written statement may, to the extent deemed advisable by the Board, contain a statement of the reasons for the removal.
The Manager shall be chosen on the basis of executive and administrative abilities and personal qualifications for the administration of the office and the carrying out of the duties of the office as set forth in this chapter. The Manager need not be a resident of the township.
Before entering upon his or her duties, the Manager shall give a bond to the township with sufficient surety as approved by the Board in the sum of $150,000, conditioned upon the faithful performance of his or her duties, the premium for said bond to be paid by the township out of its general fund.
The compensation of the Township Manager shall be set by resolution of the Board and paid out of the general fund of the township. The compensation of the Manager shall be set at the time of his or her employment and may be adjusted from time to time by resolution of the Board.
The Manager shall be the chief administrative officer of the township, and he or she shall be responsible to the Board for the proper, efficient and economical administration of the affairs of the township. The Manager shall conduct himself or herself at all times with complete fidelity to the township and only in such ways as will reflect credit upon and benefit to the township and its government. The powers and duties of the Township Manager shall be as set forth in this chapter and any amendments hereto and shall include such of the nonlegislative powers and duties of the Board as shall herein be delegated to the Manager, subject to recall by the Board of any part or all of the powers and/or duties herein conferred. The Manager shall have general supervision of the business affairs of the township and administration of township business, which powers and duties shall include the following:
The Manager shall supervise and be responsible for the activities of all municipal departments except the Police Department. The Manager shall assist the Chief of Police or ranking officer of the Police Department in the budgetary and purchasing functions of that Department, but the Manager shall not exercise operational control or supervision over the activities of the Police Department.
The Manager shall hire and, when deemed necessary, shall suspend or discharge any employee of the township, other than a police officer; provided, however, that any such hiring or discharge shall not become effective until approved by the Board. The Manager shall recommend to the Board compensation to be paid to any township employee to be so hired.
The Manager shall prepare and submit to the Board, not less than 45 days before the close of each fiscal year, a budget for the next fiscal year. In preparing the budget, the Manager, or any person designated by the Manager, shall obtain from the head of each department, agency, board or commission, or any qualified member thereof, estimates of revenues and expenditures for the next fiscal year and such other data as the Manager shall require. The Manager shall review such estimates, and give them due consideration before submitting to the Board the budget for the next fiscal year, but the Manager shall not be bound by any such estimates.
The Manager shall be responsible for the administration of the budget as submitted to the Board, or as amended by it, after its adoption by the Board.
In conjunction with the preparation of the yearly budget, the Manager shall develop long-range fiscal plans for the municipality, and shall present such plans to the Board annually for its review.
The Manager shall hold such other township offices and head such township departments as the Board may from time to time direct.
The Manager shall attend all meetings of the Board and shall have the right to take part in its discussions. The Manager shall receive notice of all special meetings of the Board. The Manager shall receive notice of all special meetings of all other township boards, agencies or commissions, and shall have the right to attend all such meetings.
The Manager shall prepare an agenda for each meeting of the Board and shall supply such information to the Board as he or she deems pertinent thereto.
The Manager shall keep the Board informed as to the conduct of township affairs; shall submit periodic reports on the condition of township finances and shall submit such other reports as he or she deems advisable or as the Board shall request; and shall make such recommendations to the Board as he or she deems advisable.
The Manager shall submit to the Board, as soon as possible after the close of each fiscal year, a complete report on the finances and administrative activities of the township for the preceding year.
The Manager shall oversee the administration of all township ordinances, such franchises, leases, permits and privileges as may from time to time be granted by the township and such contracts as may be entered into by the township and shall see that all the terms and conditions of all of the foregoing are observed.
The Manager shall recommend to the Board the employment of such experts and consultants as the Manager deems advisable to perform work and/or to offer advice in connection with any of the functions of the township, and the Manager shall recommend to the Board compensation to be paid to any such expert or consultant so hired.
The Manager shall attend to the letting of contracts in form, substance and manner as provided by law, and the Manager shall supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed by statute or ordinance upon some other township officer or official.
The Manager shall see to it that all money owed the township is promptly paid and that proper proceedings are taken for the security and collection of all claims of the township.
The Manager shall be the purchasing officer of the township and he shall purchase in accordance with law, including particularly the provisions of the Second Class Township Code,[1] all supplies and equipment for the township and for its departments, including the Police Department, and for such other offices, agencies, departments, boards and commissions as the Board may from time to time direct.

All complaints regarding township services shall be referred to the Township Manager. The Manager, or such other person as may be designated by the Manager, shall investigate and, insofar as possible, dispose of such complaints, and the Manager shall report thereon to the Board.
The Manager shall thoroughly analyze all matters requiring Board action and shall fairly and objectively present to the Board all facts and other information pertinent to such action.
The Manager shall maintain a high level of public relations for all elements of township government and shall prepare such periodic reports of township activity and such other information as may be directed from time to time by the Board.
The Manager shall assume such other responsibilities and perform such other duties as the Board may from time to time direct.
If the Manager shall become ill, be absent from the township or be otherwise unable to perform the duties of the office, the Board may designate one qualified person of the township staff to perform the duties of the Manager during the Manager's absence or disability.
