The Mechanical Code of Willistown Township previously adopted, being the BOCA Basic/National Mechanical Code/1984, is hereby amended to adopt the changes made by the promulgating agency thereof, the Building Officials and Code Administrators International, Inc., in the 1993 Edition of the BOCA National Mechanical Code, so that, from and after the effective date of this chapter, the Mechanical Code of Willistown Township shall be the BOCA National Mechanical Code/1993, together with the supplements and amendments as hereinafter set forth in § 72-9 of this chapter.
The BOCA National Mechanical Code/1993 is hereby
further supplemented and amended as follows:
A.Â
Section M-101.1 is supplemented by inserting "Willistown
Township" as the name of the jurisdiction.
B.Â
Section M-113.2 concerning fees for periodic inspections
is deleted in its entirety and in place thereof it is hereby substituted
with the following:
M-113.2 Periodic inspections: The fees for all
periodic inspections shall be paid in accordance with a schedule of
fees to be prescribed by the Board of Supervisors by resolution of
said Board.

Section M-113.3 concerning fee schedules is deleted
in its entirety and in place thereof it is hereby substituted with
the following:
M-113.3 Fee schedule: The fees for all mechanical
work shall be paid in accordance with a schedule of fees to be prescribed
by the Board of Supervisors by resolution of said Board.

Section M-116.4 concerning violation penalties is
deleted in its entirety and in place thereof it is hereby substituted
with the following:
M-116.4 Violation penalties: Any person who
shall violate a provision of this code or shall fail to comply with
any of the requirements thereof or who shall erect, install, alter
or repair mechanical equipment or systems in violation of the approved
construction documents or directive of the Code Official or of a permit
or certificate issued under the provisions of this code, in addition
to any other remedy available under law or equity, shall, upon conviction
thereof, be sentenced to pay a fine of not more than $1,000 for each
offense, together with the costs of prosecution, which fine may be
collected by suit or summary proceeding brought in the name of the
Township before any District Justice. Every day that a violation of
this code continues shall constitute a separate offense. All fines
and penalties collected for the violation of this code shall be paid
over to the Township treasury. Upon judgment against any person by
summary conviction or by proceedings by summons on default of the
payment of the fine or penalty imposed and the costs, the defendant
may be sentenced and committed to the Township lockup for a period
not exceeding five days or to the county jail or workhouse for period
not exceeding 30 days.

Section M-117.2 concerning unlawful continuance is
deleted in its entirety and in place thereof it is hereby substituted
with the following:
M-117.2 Unlawful continuance: Any person who
shall continue any work in or about the structure having been served
with a stop-work order, except such work as that person is directed
to perform to remove a violation or unsafe condition, in addition
to any other remedy available under law or equity, shall, upon conviction
thereof, be subject to a fine and imprisonment as provided in Section
M-116.4 above. Every day that a violation of this section continues
shall constitute a separate offense.

Section M-202.0 is supplemented by adding at the end
thereof the following: "Whenever 'jurisdiction' or 'Township' is referred
to herein, such term shall be deemed to mean the Township of Willistown,
Chester County, Pennsylvania; whenever the term 'administrative authority',
'appointing authority' or 'chief appointing authority' is used herein,
it shall be deemed to mean the Board of Supervisors of the Township
of Willistown."
